Under the Supplements to the Law, the right to shortened work hours will be accorded to a parent of a child with serious development disabilities. Also, provisions were made more precise in regard to the regulation of labour-legal status of employees in associations and foundations registered at the state level, due to peculiarities of their operation.
A new definition of a term ‘trainee’ provides for a possibility for trainees and volunteers engaged in a court and prosecutor’s office to apply for a bar exam.
Amendments and supplements to the Law, among other things, prescribe employers’ obligation to keep the record of employees and personal files, and to tighten sanctions against employers in breach of the Labour Law.
The Ministry of Justice will provide the Proposal Law to the Parliamentarian Assembly of BIH for consideration under a regular legislative procedure.
The Council of Ministers of BIH defined a Proposal Law on Amendments and Supplements to the Law on Attorney’s Office of BIH, which defines competences of the Attorney’s Office of BIH in connection to arbitrage procedures called for under Article 7 of the Agreement between NATO members states and Partnership for Peace participating states on legal status of NATO member states’ forces..
The Ministry of Justice will provide the Proposal Law to the Parliamentarian Assembly of BIH for consideration under regular legislative procedure.
The Council of Ministers defined, by a majority vote, a Proposal Law on International Legal Assistance in Civil Matters, which enables the rationalisation and definition of standards in international legal assistance provision in civil matters.
The Law fully reflects the standards from already concluded bilateral agreements governing the international legal assistance in civil matters.
The Proposal Law regulates the way and procedures of international legal assistance provision, except in cases when an international treaty defines otherwise or if there is no international treaty.
The Ministry of Justice will provide the Proposal Law to the Parliamentarian Assembly of BIH for consideration under regular legislative procedure.
IMPLEMENTATION OF COUNCIL OF MINISTERS CONCLUSIONS AND TRADE WITH AGRICULTURAL PRODUCTS WITH THE EU
Upon a proposal of the Council of Ministers Secretariat-General, the Council of Ministers considered a Review of Implementation of Council of Ministers conclusions for the time period from January 1 to June 03, 2013, which indicates that out of total 252 conclusions, 203 or 81 per cent were realised, while 49 conclusions remain still unimplemented.
Ministries and other institutions failing to fully implement the Council of Ministers conclusions are tasked to implement them without delay and to accelerate those activities towards their implementation which require more time or cooperation with other institutions.
Ii was concluded that the realisation of the Council of Ministers conclusions should continue to be a priority of all Ministries and other institutions.
Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of BIH adopted a Comprehensive Analysis of Trade with Agricultural and Processed Agricultural Products with the European Union in 90 day time period (July-September 2013), with a special focus on the Republic of Croatia after its full integration into the EU.
The total export of agricultural products in period July-September 2013 was KM 173.41 million, while the total import was KM 675.91 million. The coverage of import by export in the reported period was improved for 25.66 per cent.
While the total export of agricultural products in July-September 2013 marked a fall of 10.34 per cent, the export of agricultural products to the EU grew by 37.13 per cent, which is a consequence of the Republic of Croatia’s entry into the EU. Also, the import of agricultural products from the EU to BIH increased in the same period, but under a lower rate in relation to the increased export rate of 8.69 per cent.
The total export of agricultural products to Croatia in the period July-September last year was KM 39.77 million, and marked a fall of 39.34 per cent relative to 2012, as a consequence of the Republic of Croatia’s EU membership and impossibility to export products of animal origin, while the total import of agricultural products from Croatia to BIH was 119.52 million, which is 45.26 per cent lower compared with the same period last year.
The Ministers adopted Information on foreign trade exchange, production trends, price levels and supply of BIH market with milk, as the most important and most delicate product from the viewpoint of domestic production, in the 90 day time period after the entry of Croatia to the EU.
The Ministry of Foreign Trade and Economic Relations will provide the Analysis and Information to the BIH Parliamentarian Assembly House of Representatives.
PROPOSAL LAWS AND BASICS FOR NEGOTIATIONS
The Council of Ministers of BIH defined a Proposal Memorandum of Understanding on cooperation in the area of logistic support between Bosnia and Herzegovina, represented by the Defence Minister, and NATO Organisation for Support (NSPO).
The Memorandum represents a legal basis for establishment of links between BIH and NATO Organisation for Logistic Support in clearly defined areas of cooperation.
The Ministry of Defence will provide the Proposal Memorandum to the Presidency of BIH for further procedure, and Defence Minister Zekerijah Osmić is proposed as the BIH signatory.
The Council of Ministers defined Proposal Basics for negotiations on a Memorandum of Understanding between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Serbia on cooperation in telecommunications.
The conclusion of the Memorandum will promote the cooperation in the area through bilateral consultations, expert missions, coordination of radio-frequency spectrum, development of new telecommunication technologies, cooperation within international organisations, and joint research projects.
The Ministry of Communications and Transport will provide the Proposal Basics to the Presidency for further procedure, and Minister Damir Hadžić is proposed as the BIH signatory.
ADOPTION OF INITIATIVES AND DESIGNATION OF NEGOTIATING DELEGATIONS
The Council of Ministers of BIH supported an Initiative of the Ministry of Finance and Treasury, and designated a negotiating team for conclusion of a Loan Agreement between the Saudi Fund for Development and Bosnia and Herzegovina for the “Infrastructure Development in Goražde ” Project.
The aim of the Project is to rehabilitate about 36 km of secondary water supply pipeline, construct a bridge over the Drina River in Vitkovići, and to modernise local uncategorised roads and town streets.
The project will be funded from the Saudi Fund for Development loan in amount of USD 6 million with term of 25 years and 5 year grace period.
The Council of Ministers of BIH endorsed an Initiative of the Ministry of Finance and Treasury, and designated a delegation for negotiations on a EUR 30,000,000.00 Loan and Project Agreement between the KfW, Frankfurt am Main, and Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury; Federation of Bosnia and Herzegovina, represented by the Federal Ministry of Finance; and Elektorprivreda (Power Utility) of Bosnia and Herzegovina, Ltd, Sarajevo for the Hydro Power Plant Janjići.
The Power Plant Janjići will be constructed on the River Bosna in the area do Zenica. The expected capacity of the plant will be 13.3MW, which will provide for additional 69GWh power generation a year. It is a clean energy to result in decreased pollution and improved climate and environment conditions.
The Project will be financed from the loan worth EUR 30 million, with 15 year term and 4 year grace period.
The Council of Ministers of BIH endorsed an Initiative of the Ministry of Finance and Treasury and designated a delegation for conclusion of a Loan Agreement between OFID and Bosnia and Herzegovina for the “Corridor V c” Project, Sub-Section Klopče-Donja Gračanica A and B components.
The Sub-Section runs north from Dirvuše-Klopče Sub-Section, as the extension of the constructed Jošanica-Drivuša motorway.
The Klopče-Donja Gračanica Sub-Section is 6.32 km long and continues to the 2.23 km long Drivuša-Klopče Sub-Section.
The master project for the Sub-Section is finalised, while the processes of land expropriation and construction permit obtaining is ongoing. A resting place with greenery is planned to be constructed on both sides of the motorway.
The construction will be financed from the OFID loan in total amount of about EUR 60 million through two lending models. The total amount of the project is EUR 116 million, and the remaining EUR 56 million will be secured by the Public Company Motorways from other loan arrangements and own resources.
The Council of Ministers adopted an Initiative of the Ministry of Finance and Treasury, and designated a delegation for negotiations on a Loan Agreement between the KfW, Frankfurt am Main, and Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury (Borrower); Federation of Bosnia and Herzegovina, represented by the Federal Ministry of Finance; and Public Company Elektroprivreda (Power Utility) of Croatian Community of Herzeg-Bosnia, Ltd. Mostar (EPHZHB) (Project Execution Agency) for an amount of EUR 100,000,000.00 for the Pump-Accumulative (reversible) Hydro Power Plan Vrilo.
The Construction of the 62MW Power Plan Vrilo and its putting in operation will enable annual electricity production of 190 GWh, with a minimum 80 per cent of peak power, and without a need for reinvestment in next 20 years. In addition, the project will secure flood protection to all houses situated in the upper basin.
The loans is worth EUR 100 million, with 15 year term and four year grace period.
COUNCIL OF MINISTERS DECISIONS
Upon a proposal of the Ministry for Haman Rights and Refugees, the Council of Ministers of BIH took a Decision amending the Decision on appointment of members of the BIH Council of Ministers Board for Roma.
The appointed 22 members of the Board for Roma are: Ivica Drmać, Miroslav Tomić, Amra Trnka – Oručević, Stanislava Tanić, Sadeta Škaljić, Ilvan Tavra, Boris Pupić, Samra Filipović - Hadžiabdić, Ivica Mladina, Drago Vuleta, Enes Šerifović, Dragiša Radić, Melina Halilović, Sead Džemaili, Mehmed Mehić, Sabahudin Tahirović, Haziri Ramadan, Šaha Ahmetović, Snježana Mirković, Jasmina Hakić, Jadranko Durić, and Indira Bajramović.
Upon a proposal of the Ministry of Security, the Council of Ministers appointed Branko Vukoja for Manager of the Agency for Education and Professional Training of Staff, as the best candidate from the list of candidates, after an interview and proposal submission to the selection committee.
Upon a proposal of the Ministry of Security, the Council of Ministers took a decision on a minimum amount of resources needed for support of foreigners for the time of their intended stay in Bosnia and Herzegovina, which defines that a foreigner, during his/her entry to BIH must have available KM 150 or equivalent in foreign currency for each day of his/her intended stay in BIH.
Upon a proposal f the Ministry of Justice, the Council of Ministers took a decision to establish a Supervisory Body for monitoring of implementation of the State Strategy for Processing of War Crimes Matters.
Milorad Novković of the High Judicial and Prosecutorial Council was appointed as President of the nine-member Supervisory Board, and Milana Popadić of the Ministry of Justice as Vice-President.
This Supervisory Body will, among other things, direct the operations of all bodies responsible for implementation of strategic measures, assess the results achieved against the expected ones, instruct on improvements in implementation of the State Strategy for processing of war crime files, and report quarterly to the Council of Ministers.
Upon a proposal of the Ministry of Finance and Treasury, the Council of Ministers took a decision to allow issuance of a state guarantee for a Loan Contract for the Central Heating in Pale Project between the District Heating Facility Pale jsc. and European Bank for Reconstruction and Development, for amount of EUR 4.5 million, with the accompanying charges.
The aim of the Project is to develop a new district heating facility on biomass and to reconstruct and extend the heating pipeline for heat distribution, while the users will benefit from the installed measurement of heat and thermostat radiator valves on each radiator.
Upon a proposal of the Directorate for European Integrations, the Council of Ministers took a decision on mandatory European integrations training, which consists of 13 training units, among which there the basics of EU arrangements, EU law, IPA funds, strategic planning in the context in aid programming, and reporting skills.
This would help clearly define the required level of knowledge for execution of certain assignments, which is expected to add quality to human resources development efforts, along with streamlining defining needed competences for certain tasks.
Upon a proposal of the Ministry of Justice, the Council of Ministers took a Decision to form a Work Group for assessment of alignment of regulations in Bosnia and Herzegovina with the Council of Europe Convention on laundry, search for, seizure and confiscation of revenues from criminal operations and on financing terrorism (CEST 198).
The Work Group, comprised of 15 State and Entity and Brčko District institutions representatives, was set a 90 day deadline to harmonise BIH regulations with the Warsaw Convention, and to submit to the Council of Ministers a report including a set of measures for removal of eventual deficiencies.
INFORMATION AND REPORTS
The Council of Ministers adopted Information of the Ministry of Foreign Trade and Economic Relations on implementation of the JICA Project “International Tourist Corridor in Herzegovina and Environmental Protection”, launched in 2012 and planned to last three years, i.e. to June 2015.
The main purpose of the Project is to establish sustainable mechanisms for development of tourism through a Public-Private Partnership model to result in the establishment of an international tourist corridor in Herzegovina.
Earlier, the Council of Ministers of BIH adopted Information of the Ministry of Foreign Trade and Economic Relations on cooperation with international institutions active in the tourism sector in Bosnia and Herzegovina in the course of 2013.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of BIH took note of a Report of the Committee for procurement of facilities for the needs of the diplomatic-consular network of BIH in Zagreb, and tasked the Committee to keep looking for offers of appropriate facilities, having regard of the tasks defined the decision on its foundation .The Committee is tasked to submit to the Council of Ministers of BIH its activity report by June 30, 2014.
Upon a proposal of the Ministry of Communications and Transport, the Council of Ministers adopted a Report from a meeting of the Bosnia and Herzegovina - Republic of Croatia Joint Committee under International Road Transport Contract, held in Sarajevo, on September 26 and 27, 2013. The Ministry of Communications and Transport of BIH will inform all relevant actors in connection with activities and conclusions of the Joint Committee.
The meeting, among other things, supported a proposal of BIH Delegation to increase the number of permits for transit of goods from the third countries from current 7,000 to 8,000.
Upon a proposal of the Ministry of Security, the Council of Ministers of BIH adopted a Report on activities of the Operative Work Group for Combating Illegal Arms Trade in Bosnia and Herzegovina for the time period May 8 – December 31. 2013.
According to the report, total 5,094 pieces of arms and explosive devices were voluntarily handed over or seized, out of which 3,112 pieces of arms and explosive devices (62 per cent) were voluntarily handed over and found, while 127 (2 per cent) pieces of arms were seized under relevant cantonal legislation; 1,823 (36 per cent) pieces of arms were seized under relevant Entity and Brčko District legislation, and 32 pieces of arms (1 per cent) were seized under the BIH State legislation.
Competent prosecutorial offices in BIH were filled 613 reports on committed criminal acts, and 775 persons were reported
