AMENDMETNS AND SUPPLEMENTS TO LAW ON ADMINISTRATION DEFINED 

The Council of Ministers of BIH defined a Proposal Law on Amendments and Supplements to the Law on Administration, with suggestions tabled at the session, which will be forwarded to the Parliamentarian Assembly of BIH for consideration under urgent procedure.

The Law amendments and supplements will enable high quality application thereof and will ensure consistent application of the Law on Amendments and Supplements to the Law on Associations and Foundations.

The Law supplements enable the Administrative Inspection to carry out direct, as well as indirect inspections by way of insight into documentation for over 2,200 non-government organisations, entered into the relevant Register with the Ministry of Justice of BIH, which eventually requires considerably less time, making the whole process more effective.

The amendments and supplements to the Law ensues, among other things, a systematic application of the Law on Civil Service in the BIH Institutions, and limits a technical mandate and acting appointment to a three-months period of time, with a possibility of its prolongation for additional three months, in justifiable cases only.

 

IDDEA TO DEAL WITH PASSPORT BOOKLETS DELIVERY IN COMPLIANCE WITH EXISTING LAWS

 

The Council of Ministers of BIH expects the Identification Documents, Evidence and Data Exchange Agency of BIH (IDDEA) to urgently take activities in order to overcome the current situation concerning ensuring passport booklets for citizens of Bosnia and Herzegovina, in accordance with the existing legal solutions, and report it to the Council of Ministers of BIH.

Simultaneously, the IDDEA will launch urgently a public procurement procedure for passport booklets, and in that a specific public procurement expertize would be necessary to include, while the admitted quotes from the relevant Appellation Office decision should be complied with.

The IDDEEA is responsible to inform the Council of Ministers of BIH timely on the course of implementation of the relevant public procurement procedure for selection of passport booklets supplier.

The Council of Ministers of BIH took the above conclusions after it was made familiar of the issues, presented in IDDEEA’s information, about the causes of problems with passport booklets, which are to arose after a contract with the “Muehlbauer” Company, the current supplier, expires on March 21 this year.

The Council of Ministers of BIH took note that the Appellation Office has twice before stopped the public procurement procedure, and that thee regulations in force do not allow making of supplies of passport booklets.

According to the IDDEEA, the Rulebook on Amendments of Rulebook on form, contents and minimum protection elements of ordinary, diplomatic and service passports will take force on January 18 this year, and that would remove objections made in the Appellation Office Decision and enables competitive procedure.

 

BIH AND SERBIA IMPLEMENT CONVENTION ON POLICE COOPERATION IN SEE

 

The Council of Ministers defined a Proposal Protocol between the Ministry of Security of Bosnia and Herzegovina and Ministry of Internal Affairs of the Republic of Serbia on implementation f Articles 13-15 of the Convention on Police Cooperation in the South Eastern Europe, which will contribute to increased stability and security in the region.

The Protocol sets forth more specifically the way of implementation of an urgent pursuit across the shared land border between BIH and Serbia, cross-border surveillance and controlled deliveries at territories of the countries- signatories.

The Ministry of Security will provide the Proposal Protocol to the BIH Presidency for further procedure of approval, with incorporated corrections made at the session, while the Minister fo security was proposed for the BIH signatory.

 

BIH AND USA IMPROVE PROCEDURES FOR DATA EXCHANGE ON TERORRISM

 

The Council of Ministers of BIH defined a Proposal Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the United Saes of America on data exchange concerning security checks on terrorism, which additionally improves joint efforts in prevention and dealing with international terrorism.

This would improve the exchange of security checks between the Council of Ministers of BIH and Government of the United States of America with a view at an effective fight against terrorism. The BIH contact point will be the Ministry of Security Department for International Cooperation. The Ministry of Security will provide the Proposal Agreement, with basics for its conclusion to the BIH Presidency, and the Ministry of Security was proposed for the BIH signatory.

 

BIH ACCEEDS TO AMEDMETNS TO ROME STATUTE

 

The Council of Ministers of BIH defined a Proposal Basics for acceding of Bosnia and Herzegovina to Amendments of the Roma Statute of the International Criminal Court, by which BIH reaffirms its commitment to promotion of a joint criminal policy among the Council of Europe members.

These are the two amendments, adopted under the resolutions 5 and 6 in June 2010, at the Kampala Conference, which secure protection for individuals from the most serious criminal acts.

The amendments were ratified 32 states, members of the Roma Statute, by October 2016. The Ministry of Justice will provide the Proposal Basics to the BIH Presidency for further procedure, and the Head of BIH Mission to UN was proposed as the BIH signatory.

 

DRAFT DEVELOPMENT POLICY OF IT SOCIETY IN BIH BY 2020 TO RECEIVE ENTITIES’ OPINION

 

The Council of Ministers BIH adopted a Draft Development Policy of IT Society in Bosnia and Herzegovina for 2016-2020, which will be provided to the Entity and Brčko District of BIH competent authorities for opinion.

The Council of Ministers of BIH will, upon receiving the opinion, reconsider the Proposal Policy for its final adoption.

 

VISA ISSUANCE AT “DOLJANI” BORDER-CROSSING

 

The Council of Ministers of BIH took a Decision, upon a proposal of the Ministry of Security, to supplement a Decision on defining international border-crossings in Bosnia and Herzegovina where visas may be issued.

Under the Decision, the “Doljani” international border-crossing is being included among the border-crossings where visas may be issued.

So, visas may be issued at 16 international border crossings, which includes all international airports in BIH, as well as the majority of the most occupied land border-crossings towards the neighbouring countries.

By adopting appropriate regulations and defining international border-crossings at which visas may be issued, and by putting into operation an application for digital visa issuing, now in function since 2005, Bosnia and Herzegovina has considerably reduced the number of visas issued at the border, as recommended by the European Commission, and thus created conditions for more effective control of state border crossing.

 

VRHBOSANSKA ARCHDIOCESE GETS “FORD FOCUS” USED BY POPE FRANCIS

 

The Council of Ministers of BIH took a decision, upon a proposal of the Ministry of Security, on transfer of tile over a fixed asset, by which the Directorate for Coordination of Police Bodies in BIH transfers its ownership over a motor vehicle “ford focus” to the Vrhbosanska Archdiocese.

It is a passenger car used by Pope Francis during his visit to Sarajevo, and since it was produced in 2005, tis value for the Vrhbosanska Archdiocese is not material but rather spiritual one.

 

CAPACITY STENGTHENING FOR RESCUING CITIZENS FROM FLOODS

 

The Council of Ministers of BIH adopted Information of the Ministry of Security on implementation of a grant in equipment for rescuing on water under the project of formation, equipping and training of the Joint Regional Unit for Disaster Response In case of floods, within an Initiative for Disaster Prevention and Alert in South Eastern Europe.

The Ministry of Security will, in cooperation with responsible civil protection bodies in the Federation of BIH and Republika Srpska, secure an adequate use and maintenance of the equipment and participation of their teams in training planed within the project.

The Entity Governments were recommended to intensify work on formation of specialised civil protection forces and their inclusion into the specialised unit for protection and rescue at the level of Bosnia and Herzegovina, in accordance with a Framework Law on Protection of People and Material Goods from Natural and Other Catastrophes.

After BIH last year received equipment for two rescue teams, worth KM 61,397.41, education and training courses were planned in 2017 for these nine-member teams for rescue n water of the Republika Srpska Civil Protection Directorate and Federal Civil Protection Directorate. After the end of training courses, a joint field exercise was planned at the end of the project.

 

TO CONTINUE COMMUNICATIONS MARKET DEVELOPMENT

 

The Council of Ministers took note of Information of the Ministry of Communications and Transport on the state of affairs in the area of communications, accompanied by proposal measures for further development of communications market.

The Ministry of Communications and Transport of BIH and BIH Communications Regulatory Agency will intensify their future joint activities for defining proposal development and other strategies and activities in legal and regulatory coordination in the sector.

These are the final preparations of a Proposal Policy of Telecommunications Sector in Bosnia and Herzegovina for 2017-2021, preparation of a Proposal Strategy of Broadband Access in Bosnia and Herzegovina and other strategic and plan documents in the communications area.

 

TO SET-UP USEFUL REGULATIONS EFECTS EVALUATION SYSTEM

 

The Council of Ministers of BIH adopted amendments and supplements to the Single Rules for Development of Legal Acts in the Institutions of Bosnia and Herzegovina, which will, after its technical refinement, be forwarded to the BIH Parliamentarian Assembly by the Ministry of Justice for further procedure.

The amendments and supplements follow the Methodology of evaluation of effects in regulations development process, which creates conditions of development and adoption of high quality regulations, based on the available facts and proofs, s that regulations should be implemented for the least possible expenditures and should not create obstacles to business environment, to citizens and society.

Along with the Amendments and Supplements to the Rules, an Analysis of effects evaluation system in developing policies/regulations in the BIH Institutions was made.

This would establish an effective system for policies/regulations effects evaluation at BIH level, which follows the procedure and practice of the evaluation during development of public policies of the European Union and its member countries.

 

CoM TAKES TWO REGULATIONS IN COMPLIANCE TO LAW ON ELECTRONIC SIGNATURE

 

The Council of Ministers of BIH took, upon a proposal of the Ministry of Communications and Transport, a Regulation on milder conditions for issuance of relevant certificates and Regulation on verifier register, for the reason of a full implementation of the Law on Electronic Signature.

The Regulations prescribe milder conditions for issuance of relevant certificates and requirements verifier needs to meet for certificates issuance in the sense of application of international standards and reliable service provisions, including the contents and way of evidence keeping of verifiers who issue relevant certificates.

These Regulations will enable the beginning of operation of the Supervision and Accreditation Office under the Ministry of Communications and Transport of BIH.

 

TASK GROUP FOR MONEY LAUNDERING AND FINANCING TERRORISM RISK ASSE4SSMENT

 

The Council of Ministers of BIH grated tis consent to a decision of the Ministry of
Security on appointment of a Work Group and Sub-Groups for development of money-laundering and financing of terrorism risk assessment in Bosnia and Herzegovina.

The Work Group will draft and provide to the Council of Ministers f BIH by April 15, 2017 a Money-Laundering and Financing of Terrorism Risk Assessment in BIH, while it will prepare, by October 10, 2017, a 2018-2022 Action Plan for Fight against Money-Laundering and Financing of Terrorism in Bosnia and Herzegovina.
