The 85th Session of the BiH Council of Ministers Held

The BiH Council of Ministers agreed upon a Proposal of modifications and amendments to the Law on Deposit Insurance in Banks of Bosnia and Herzegovina at its session in Sarajevo chaired by the chairman Mr. Nikola Špirić. A proposer, namely the Ministry of Finance and Treasury, will put forward the Law proposal to the Parliament to be considered in a basic legislative procedure.       

The BiH Council of Ministers defined the Proposed agreement on establishing the Regional School for Public Administration and adopted the Report on conducted negotiations.
A proposer, namely the Ministry of Justice, will put the Proposed agreement forward to the BiH Presidency for a further procedure, whereas the minister Bariša Čolak was proposed a BiH signatory.

The BiH Council of Ministers defined the Proposed agreement between the BiH Council of Ministers and the Government of the Republic of Serbia in the area of education, culture and sports.
A proposer, namely the Ministry of Civil Affairs, will put the Proposed agreement forward to the BiH Presidency for a further procedure, whereas the minister Sredoje Nović was proposed a BiH signatory.

The BiH Council of Ministers defined the Proposed agreement between Bosnia and Herzegovina and the Republic of Slovenia on legal aid in civil and criminal issues.

A proposer, namely the Ministry of Justice, will put the Proposed agreement forward to the BiH Presidency for a further procedure, whereas the minister Bariša Čolak was proposed a BiH signatory.  

The BiH Council of Ministers defined a Proposal of bases for conducting negotiations aiming at concluding a Protocol on preventing pollution of waters caused by sailing.  
A proposer, namely the Ministry of Communications and Transport, will put the Proposal of the bases forward to the BiH Presidency for a further procedure, whereas the minister Božo Ljubić was proposed a BiH signatory.
 
The BiH Council of Ministers defined a Proposal of bases for conducting negotiations aiming at concluding the Agreement between the BiH Council of Ministers and the Government of Bulgaria about cooperation in the area of a health care system. 
A proposer, namely the Ministry of Civil Affairs, will put the Proposal of the bases forward to the BiH Presidency for a further procedure, whereas the minister Sredoje Nović was proposed a BiH signatory.  

The BiH Council of Ministers will put the proposal that the minister of civil affairs Mr. Sredoje Nović be appointed as a signatory of the Agreement about cultural, educational and sports cooperation between Bosnia and Herzegovina and the Republic of Argentina forward to the BiH Presidency, in preference to the previously appointed Minister of foreign affairs, Mr. Mladen Ivanić. The Ministry of Civil Affairs will deliver this proposal on a signatory substitution. 

Upon a proposal of the Ministry of Security, the BiH Council of Ministers, made a Decision on establishing a Protection and Rescue Coordination Body of Bosnia and Herzegovina.
Upon proposal of the Ministry of Security, the BiH Council of Ministers, made a Decision on approving funds from a budgetary reserve of the BiH Institutions and international obligations of Bosnia and Herzegovina for the year 2009 and approving a structure of expenditures of the Forensic Examination and Expertise Agency.

In line with this decision, the Forensic Examination and Expertise Agency was allocated funds from the budgetary reserve for the year 2009 in the amount of 683,000.00 KM for the period of March 1st – December 31st, 2009, which are designated for current costs (494,000.00 KM) and equipment procurement (189,000.00 KM).
The Ministry of Finance and Treasury and the Forensic Examination and Expertise Agency are responsible for the decision implementation.


Upon a proposal of the Ministry of Security, the BiH Council of Ministers made a Decision on approving funds from the budgetary reserve of the budget of the BiH Institutions and the international obligations of Bosnia and Herzegovina for the year 2009 and approving a structure of expenditures of the Police Support Agency.
In line with this decision, the Police Support Agency was allocated funds from the budgetary reserve for the year 2009 in the amount of 663,000.00 KM for the period of March 1st – December 31st, 2009, which are intended for current costs (476,000.00 KM) and equipment procurement (187,000.00 KM).
The Ministry of Finance and Treasury and the Police Support Agency are responsible for the decision implementation.


Upon a proposal of the Ministry of Security, the BiH Council of Ministers made a Decision on approving funds from the budgetary reserve of the budget of the BiH Institutions and the international obligations of Bosnia and Herzegovina for the year 2009 and approving a structure of expenditures of the Personnel Education and Training Agency.
In line with the decision, the Personnel Education and Training Agency was allocated funds from the budgetary reserve for the year 2009 in the amount of 562,656.00 KM for the period of March 1st – December 31st, 2009, which are intended for current costs (379,356.00 KM) equipment procurement (183,300.00 KM).
The Ministry of Finance and Treasury and the Personnel Education and Training Agency are responsible for the decision implementation.


Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the BiH Council of Ministers BiH made a Decision on reallocating funds from direct transfers to the budget of the BiH Veterinary Office.


Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the BiH Council of Ministers BiH made a Decision on establishing the BiH Advisory Council for Agriculture, Food and Rural Development, namely a specialized body whose aim is to provide effective mechanisms of consultations, participation, coordination and legitimacy of making decisions in the given sector. 


Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the BiH Council of Ministers BiH made a Decision on adopting the State Annual Plan of Consumer Protection Organization in Bosnia and Herzegovina for the year 2009.


The BiH Council of Ministers made a Decision on modifications and amendments of the Decision on organization and activities of the BiH Export Incentive Council.
These modifications and amendments, proposed by the Ministry of Foreign Trade and Economic Relations, in part result in broadening the structure of the BiH Export Incentive Council, and consequently it includes representatives of the BiH Ministry of Finance and Treasury, and Ministries of energy, mining and industry at the level of entities, whereas the number of export-oriented companies that are members of the Council is increased from six to seven.

Moreover, mandate of the members from the export group is extended from one to three years and a position of vice president of the Export Incentive Council appointed from the export group is introduced, which ensures their greater influence exercised upon the work of this body.

 

The BiH Council of Ministers made a decision on allocating 201,388.00 KM from the budgetary reserve of the BiH institutions and international obligations of Bosnia and Herzegovina for the year 2009 for the requirements of the Court of BiH.

Upon a proposal made by the General Secretariat of the BiH Council of Ministers, the BiH Council of Ministers made a formal Decision on appointing the members of the Working Group for Property Register.

Upon a proposal of the Ministry of Security, the BiH Council of Ministers adopted the Information with regard to the Report of the implementation of the GRECO Recommendations for Bosnia and Herzegovina. The GRECO Report (The Council of Europe Group of States against Corruption) on evaluation of the implementation of the recommendations for Bosnia and Herzegovina (Compliance Report on Bosnia and Herzegovina) within the Second Evaluation Report for the Situation Estimate in Bosnia and Herzegovina is adopted.
The Council of Ministers approved publishing the GRECO Report on evaluation of the implementation of the recommendations for Bosnia and Herzegovina on the GRECO web page and obliged the competent institutions and agencies in Bosnia and Herzegovina to take up the implementation of those recommendations evaluated as unsatisfactory in the GRECO Report.

The BiH Council of Ministers adopted the Information of the Ministry of Foreign Affairs and Economic Relations about weapons and military equipment production and circulation.

The Ministry is obliged to deliver the Information to the BiH Presidency.

The BiH Council of Ministers adopted a Report by the minister Mladen Zirojević about a Ministerial Conference held within the 5th World Forum on Waters in Istanbul from March 20th-22nd, 2009.

The BiH Council of Ministers accepted individual work programmes for the year 2009, namely:

-Work Programme of the Food Safety Agency in Bosnia and Herzegovina for the year 2009;

- Work Programme of the Service for Joint Operations of the Institutions of Bosnia and Herzegovina for the year 2009.

 

The BiH Council of Ministers adopted a document on economic trends in Bosnia and Herzegovina for the period January-September, 2008, as prepared by the Economic Planning Directorate.

 

The BiH Council of Ministers granted its assent for the Rulebook of modifications and amendments of the Rulebook of internal organization of the General Secretariat of the BiH Council of Ministers.

 

Upon request of the Ministry of Finance and Treasury, the BiH Council of Ministers accepted an Opinion on the Proposed Law on modifications and amendments of the Law on Central Bank of Bosnia and Herzegovina, as proposed by a representative Milorad Živković.

The Ministry will deliver the Opinion to the House of Representatives of the Parliament of Bosnia and Herzegovina.

 

The BiH Council of Ministers did not accept an Opinion of the Ministry of Finance and Treasury, or the BiH Indirect Taxation Authority on the Proposed Law on fiscal safes, as proposed by a representative Jozo Križanović.

 

The BiH Council of Ministers did not accept an Opinion of the Ministry of Finance and Treasury on the Proposed Law on fiscal safes, as proposed by House of Representatives of the Parliament of Bosnia and Herzegovina.

 

Upon request of the Ministry of Finance and Treasury, the BiH Council of Ministers defined je the Opinion on an authentic interpretation of the Article 28 of the Law on fulfilling obligations with regard to the account of past foreign-exchange savings.

The Ministry will deliver the Opinion to the House of Representatives of the Parliament of Bosnia and Herzegovina.

 

Upon a proposal of the Ministry of Communications and Transport, the BiH Council of Ministers defined the Opinion on an authentic interpretation of the Article 36, Paragraph 2 and 3, and the Article 40, Paragraph 1 of the Communication Law of Bosnia and Herzegovina.

The Ministry will deliver the Opinion to the House of Representatives of the Parliament of Bosnia and Herzegovina.

Upon a proposal of the Ministry of Communications and Transport, the BiH Council of Ministers defined the Opinion on an authentic interpretation of the Article 1, Paragraph 5 of the Aviation Law of Bosnia and Herzegovina.

The Ministry will deliver the Opinion to the Constitutional Legal Commission of the House of Representatives of the Parliament of Bosnia and Herzegovina.

 

The BiH Council of Ministers is informed about the conclusions 51, 54 and 55 made at the session of the Presidency of Bosnia and Herzegovina.

The Ministry of Civil Affairs and the Ministry of Foreign Trade and Economic Relations are responsible for the realization of the conclusion 51 made at the regular session of the BiH Presidency, which relates to the realization of the conclusions made by the World Heritage Committee on the Mehmed paša Sokolović Bridge in Višegrad.

The Ministry of Defense is responsible for the realization of the conclusion 54 made at the regular session of the BiH Presidency, which relates to the Information made by the Ministry of Defense BiH with regard to organizing an exercise “Joint Efforts 2009” in barracks of the Armed Forces BiH Kozara in Banja Luka from September 4th to 17th, 2009.
The Ministry of Defense and the Ministry of Foreign Affairs are responsible for the realization of the conclusion 55 made at the regular session of the BiH Presidency, which relates to prospects of participation of Bosnia and Herzegovina in the NATO Membership Action Plan (MAP).

The BiH Council of Ministers is informed about the conclusions made at the 37th session of the Foreign Affairs Commission of the House of Representative of the Parliament of Bosnia and Herzegovina on the occasion of a discussion on the Work Report of the Delegation of the Parliament in the European Council Parliament, and therefore obliged the Ministry of Foreign Affairs to:
- intensify activities related to fulfilling post-accession obligations from the European Council in cooperation with competent institutions,

-undertake necessary activities aiming at putting the proposal on ratification of the European Charter for Regional or Minority languages forward into a parliamentary procedure,

-make a proposal of a report of the implementation progress of the Recommendation 1843, Paragraph 2.3 of the European Council.

 

The BiH Council of Ministers is informed about the conclusion made at the 39th session of the Finance and Budget Commission of the House of Representatives of the BiH Parliament with regard to the memo of the Independent union of civil servants and police officers in the BiH institutions, court authorities and BiH public institutions.

The Ministry of Finance and Treasury is responsible for the realization of the conclusion.

The BiH Council of Ministers is informed about the conclusions made at the 27th session of the House of Peoples of the BiH Parliament and therefore concluded the following:

-The Narcotics Abuse Fight Commission is tasked to deliver a proposal of the action plan related to narcotics supervision strategy, preventing and combating narcotics abuse in BiH for the period 2009-2013 to the Council of Ministers within 60 days;

-Ministries and other institutions are obliged to commence the realization of the conclusions made at the 27th session of the House of Peoples of the BiH Parliament in accordance with their competencies.

The BiH Council of Ministers is informed about the conclusions of the 50th and 51st sessions of the House of Representatives of the BiH Parliament and therefore concluded the following:
-The Ministry of Justice in cooperation with the Complaint Consideration Office is responsible for the realization of the conclusions made at the 50th session of the House of Representatives, which relate to the issues of the Office,

-Inter-department Working Group for visa liberation negotiations for BiH citizen is responsible for the realization of the conclusions made at the 51st session of the House of Representatives.

With regard to the realization of the conclusion made at the 51st session of the House of Representatives, which relates to the realization of the conclusions of the House of Representatives by the Council of Ministers, ministries are within their competencies obliged to prioritize and commence the realization of non-implemented conclusions.

The BiH Council of Ministers is informed of the conclusions of the 89th session of the Government of the Federation of Bosnia and Herzegovina.

The Ministry of Foreign Affairs and Economic Relations is responsible to deliver the conclusions to the competent Ministry in Republika Srpska.

The BiH Council of Ministers defined responses to the questions posed by representatives/delegates, namely: of the Ministry of Civil Affairs to the question of Ms. Azra Alajbegović, of the Council of Ministers Chairman to the question of Mr. Denis Bećirović, of the Ministry of Foreign Trade and Economic Relations to the question of Mr. Šefik Džaferović, of the Ministry of Security to the question of Mr. Adem Huskić, of the Ministry of Defense to the question of Ms. Azra Alajbegović and of the Office of the representative/agent of the BiH Council of Ministers before the European Court for Human Rights to the question of Mr. Rifat Dolić.

The General Secretariat of the BiH Council of Ministers will deliver the responses to the Parliament of Bosnia and Herzegovina.

The BiH Council of Ministers called upon the competent institutions of BiH to strengthen their activities related to supervision and coordination of information about H1N1 flu outbreak in the world in order to provide timely information for BiH citizens on current situation development. (end)
