The Council of Ministers of B-H defined a Proposal Law, by majority vote, on B-H State Aid System. 

The proposer, Ministry of Foreign Trade and Economic Relations, is tasked to provide the Proposal Law to the Parliamentarian Assembly of Bosnia and Herzegovina for consideration under a regular legislative procedure.

The Council of Ministers of B-H defined a Proposal Implementation Protocol between the Council of Ministers of Bosnia and Herzegovina and Government of Hungary for Implementation of an Agreement between the Council of Ministers of Bosnia and Herzegovina and European Community on Readmission of Persons Not Holding Residence Permit.

The Ministry of Security is charged to provide the Proposal Implementation Protocol to the Presidency of Bosnia and Herzegovina for further procedure, and the Minister of Security of B-H is proposed as the B-H signatory.

The Council of Ministers of B-H defined Proposal Basics for Initiating Bosnia and Herzegovina’s accession to the International Convention on the Harmonised Commodity Description and Coding System, of June 14, 1983, and Protocol on Amendments and Supplements to the Convention, of June 24, 1986.

The Ministry of Foreign Trade and Economic Relations is tasked to provide the proposal Basics to the Presidency of B-H for further procedure, and Chairman of the Presidency of Bosnia and Herzegovina is proposed as the signatory on behalf of B-H.

The Council of Ministers of B-H defined Proposal Basics for negotiations for conclusion of a Contract on Mutual Legal Assistance in Criminal Matters between Bosnia and Herzegovina and the People’s Republic of China.

The Ministry of Justice is charged to provide the Proposal Basics to the Presidency of Bosnia and Herzegovina for further procedure, and the Minister of Justice is proposed as the B-H signatory.

The Council of Ministers of B-H defined a Proposal Loan and Project Agreement, together with basics for its conclusion, between Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury, Republika Srpska, represented by the Ministry of Finance of Republika Srpska, Elektro Doboj JSC from Doboj, and KfW, Frankfurt am Main, for “Hydro Power Plant Cijevna III” Project.

The Ministry of Finance and Treasury is assigned to provide the Proposal Agreement to the Presidency of Bosnia and Herzegovina for further procedure and the Minister of Finance and Treasury is proposed as the B-H signatory.

The Council of Ministers of B-H defined Proposal Basics for negotiations for conclusion of a Contract on Mutual Legal Assistance in Civil and Commercial Matters between Bosnia and Herzegovina and the People’s Republic of China.

The Council of Ministers of B-H defined a Proposal Loan Agreement, with its basics for conclusion, for the Hospital Modernisation Project Phase III, between the Council of Ministers of Bosnia and Herzegovina, Government of Republika Srpska and the Export-Import Bank of Korea (ECDF Government Agency).

The Ministry of Finance and Treasury is assigned to provide the Proposal Agreement to the Presidency of Bosnia and Herzegovina for further procedure, and the Minister of Finance and Treasury is proposed as the B-H signatory.

The Council of Ministers of B-H considered and accepted an Initiative for negotiations for conclusion of a Loan Contract between Bosnia and Herzegovina and the European Bank for Reconstruction and Development for City Roads Project in Sarajevo Canton.

In regard to that, the following negotiating delegation was designated:

-          Minister of Finance and Treasury, or an authorised person – head of negotiating team;

-          Federal Minister of Finance, or an authorised person;

-          Minister of Transport of Sarajevo Canton, or an authorised person.

Following the negotiations, the Ministry of Finance and Treasury will act, pursuant to Article 39 paragraph (4) of the Law on Borrowing, Debt and Guarantees of Bosnia and Herzegovina, and will provide a Draft Loan Contract and Basics for its conclusion to the Council of Ministers.

The Council of Ministers of B-H considered and accepted an Initiative for negotiations for conclusion of a Loan Contract between Bosnia and Herzegovina and the European Bank for Reconstruction and Development for Banja Luka – Doboj Motorway Construction Project Phase I.

In regard to that, the following negotiating delegation was designated:

-          Minister of Finance and Treasury, or an authorised person – head of negotiating team;

-          Minister of Finance of Republika Srpska, or an authorised person;

-          Minister of Transport and Communications of Republika Srpska,  or an authorised person

-          Manager of Public Ccompany Autoputevi Republike Srpske, or an authorised person.

Following the negotiations, the Ministry of Finance and Treasury will act, pursuant to Article 39 paragraph (4) of the Law on Borrowing, Debt and Guarantees of Bosnia and Herzegovina, and will provide a Draft Loan Contract and Basics for its conclusion to the Council of Ministers.

The Council of Ministers of B-H accepted an Agreement on Amendment and Supplements to the Agreement between Bosnia and Herzegovina, Federation of Bosnia and Herzegovina, and Republika Srpska on transfer of competences and continuation of funding and operation of the Committee for Property Claims of Refugees and Displaced Persons, in accordance with Article XVI of Annex VII of the General Framework Agreement for Peace in Bosnia and Herzegovina.

The Ministry for Human Rights and Refugees is tasked to provide the Proposal Agreement to Entity Governments for consideration and adoption.

The Chairman of the Council of Ministers is proposed as the signatory of the Agreement.

The Council of Ministers of B-H tasked, by majority vote, the Ministry for Human Rights and Refugees to terminate its Contract with “Žitozajednica” Ltd. from Sarajevo on rent of office space used by the Committee for Property Claims of Refugees and Displaced Persons.

Also, the Ministry for Human Rights and Refugees is in charge to arrange, together with the Ministry of Finance and Treasury, ways of payment of financial obligations it created under above Contract.

The Ministry’s Division for Support to the Committee is in charge to take over the archives and office supplies of the Committee.

The Council of Ministers of B-H defined individual proposal decisions on ratification of agreements, contracts and conventions as follows:

-          Proposal Decision on Ratification of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of Kazakhstan on lifting visas for holders of diplomatic and service passports;

-          Proposal Decision on Ratification of a Financial Agreement between Bosnia and Herzegovina and Commission of European Communities referring to a State Programme (Part II) for 2008 under the Instrument for Pre-Accession Assistance;

-          Proposal Decision on Ratification of Addendum No.1 to a Financial Contract concerning National Programme for Bosnia and Herzegovina – Part II under IPA Programme support to transition and Institution-Building for 2008;

-          Proposal Decision on Ratification of an Agreement on Grant under an Agreement between the Ministry of Finance and Treasury of Bosnia and Herzegovina and Ministry of Foreign Affairs of Netherlands for financing of KGS 10/BA/3/1 Project;

-          Proposal Decision on Ratification of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Serbia on temporary employment of citizens of Bosnia and Herzegovina in the Republic of Serbia and citizens of the Republic of Serbia in Bosnia and Herzegovina;

-          Proposal Decision on Ratification of an Agreement on awarding the international organisation status to the International Academy for Fight against Corruption;

-          Proposal Decision on Ratification of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Indonesia on lifting visa regime for holders of diplomatic and service passports;

-          Proposal Decision on Ratification of an Appendix to the Financial Agreement between Bosnia and Herzegovina and the European Commission on Cross-Border Program Bosnia and Herzegovina – Montenegro under IPA cross-border cooperation component for 2007;

-          Proposal Decision on Ratification of an Appendix to the Financial Agreement between Bosnia and Herzegovina and the European Commission on Cross-Border Program Bosnia and Herzegovina – Serbia under IPA cross-border cooperation component for 2007;

-          Proposal Decision on Ratification of a Contract on Legal Assistance in Civil and Criminal Matters between Bosnia and Herzegovina and the Islamic Republic of Iran;

-          Proposal Decision on Ratification of Appendix No. 1 to the Financial Agreement for Implementation of National Programme for Bosnia and Herzegovina under IPA Programme – Assistance in Transition and Institution Building Component for 2007;

-          Proposal Decision on Ratification of an Appendix to the Financial Agreement between Bosnia and Herzegovina and the European Commission on Cross-Border Program Bosnia and Herzegovina – Croatia under IPA cross-border cooperation component for 2007;

-          Proposal Decision on Ratification of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Slovenia on temporary employment of citizens of Bosnia and Herzegovina in the Republic of Slovenia and citizens of the Republic of Slovenia in Bosnia and Herzegovina;

-          Proposal Decision on Ratification of the International Convention for Protection of All Persons from Enforced Disappearance, opened for signing on February 26, 2007 in Paris.

The proposer, Ministry of Foreign Affairs, will provide the proposal decisions to the Presidency of Bosnia and Herzegovina for their adoption.

Upon a proposal of the Ministry of Justice, the Council of Ministers of B-H took a Decision amending the Decision on Establishment of Supervisory Body for Implementation of State Strategy for Dealing with War Crimes Matters.

Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H took a Decision on adoption of the Consumer Protection State Annual Programme in Bosnia and Herzegovina for 2011.

Upon a proposal of the Institute for Intellectual property, the Council of Ministers of B-H took a decision on level of reimbursements for copy for private or other personal purposes of copyright works and objects bearing similar rights.

Upon a proposal of the Ministry of Justice, the Council of Ministers of B-H adopted Information on Cooperation between the Directorate for European Integrations of B-H and faculties of philosophy in Bosnia and Herzegovina.

The Directorate for European Integrations is in charge to set up priorities and develop action plan for implementation of stated goals in the areas indicated in a Memorandum, in cooperation with other parties to the Memorandum.

The Council of Ministers of B-H considered and adopted Information of the Directorate for European Integrations on a need for development of the European Integrations-Related Regulation Impact Assessment (RIA) in state-level institutions, and adopted the following conclusions:

-          All institutions are recommended to start preparing the European Integration related Regulation Impact Assessment for the most affecting regulations concerning different segments of society (budget, economy, environment, certain social groups etc.);

-          All institutions are recommended to use “A Brief EI-Related RIA Guidelines”, developed by DEI;

-          All institutions are recommended to provide for finances in their technical assistance projects fishes for  EI-related RIA development in relation to EI process concerning the most relevant regulations from their respective competences;

-          All institutions are recommended to consult the Directorate for European Integrations for development of EI-related RIA, in the sense of setting-up RIA preparation priorities, methodology, reporting structure and volume (inceptive or detailed RIAs).

The Council of Ministers of B-H considered and adopted Information of the Directorate for European Integrations on development of responses to technical information required by the European Commission.

Also, the Council of Ministers of B-H adopted a document entitled “Responses to Technical Information”, as requested by the European Commission.

The Council of Ministers of B-H considered and adopted a Report of the Directorate for European Integrations on Implementation of Transitional Agreement/Stabilisation and Accession Agreement (for January 1 – June 30, 2011), with the proposed conclusions.

The Council of Ministers of B-H considered and adopted a Semi-Annual Review of the European Partnership of Bosnia and Herzegovina Action Plan Priorities Implementation for January 1 – June 30, 2011, with information on its preparation, developed by the Directorate for European Integrations.

The Directorate for European Integrations is tasked to translate the Semi-Annual Review of the European Partnership of Bosnia and Herzegovina Action Plan Priorities Implementation for January 1 – June 30, 2011, and provide it to the European Commission.

The Council of Ministers of B-H concluded to propose to the Agency for Civil Service of B-H Amir Huskić, instead of Enes Rujanac, for member of the Job Competition Committee for selection of manager of the State Regulatory Agency for Radiation and Nuclear Safety.

Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H defined its opinion on an Amendment to Proposal Law on Amendments and Supplements to the Law on Customs Policy of Bosnia and Herzegovina, proposed by Borislav Bojić, deputy in the House of Representatives of the Parliamentarian Assembly of Bosnia and Herzegovina.

The Ministry of Foreign Trade and Economic Relations is tasked to provide the Opinion to the Parliamentarian Assembly of Bosnia and Herzegovina.

Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H defined its Opinion for an authentic interpretation of Article 28 of the Law on Single Identity Number, as proposed by the House of Peoples of the Parliamentarian Assembly of Bosnia and Herzegovina.

The Ministry of Civil Affairs is tasked to provide the Opinion to the Parliamentarian Assembly of Bosnia and Herzegovina.

Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H defined its Opinion for an authentic interpretation of Article 12 of the Law on Citizenship of Bosnia and Herzegovina, as proposed by the House of Peoples of the Parliamentarian Assembly of Bosnia and Herzegovina.

The Ministry of Civil Affairs is tasked to provide the Opinion to the Parliamentarian Assembly of Bosnia and Herzegovina.

Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H defined its Opinion for an authentic interpretation of Article 9 paragraph (5) of the Law on Domicile and Residence of Citizens of Bosnia and Herzegovina, as proposed by the House of Peoples of the Parliamentarian Assembly of Bosnia and Herzegovina.

The Ministry of Civil Affairs is tasked to provide the Opinion to the Parliamentarian Assembly of Bosnia and Herzegovina.

Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H defined its Opinion for an authentic interpretation of Article 32 of the Framework Law on High Education, as proposed by the House of Peoples of the Parliamentarian Assembly of Bosnia and Herzegovina.

The Ministry of Civil Affairs is tasked to provide the Opinion to the Parliamentarian Assembly of Bosnia and Herzegovina.

The Council of Ministers of B-H was informed of conclusions the House of Peoples of the Parliamentarian Assembly of Bosnia and Herzegovina adopted at its 3rd session, held on July 15, 2011.

Regarding the conclusions pertaining to language and letter in materials delivered for consideration and adoption in the Parliamentarian Assembly, the Council of Ministers concluded that the language and letter in materials delivered to the Parliamentarian Assembly are regulated by the Rules of Procedure of the Council of Ministers, under which the Ministries and other institutions are obliged to prepare materials from their competence in languages in official use in Bosnia and Herzegovina, i.e. Bosnian, Croatian and Serbian, in Latin and Cyrillic letters.

As to a conclusion of the House of Peoples referring to a need that, during the process of harmonisation of the legislation of Bosnia and Herzegovina with that of the EU, the proposal laws delivered for the Parliamentarian procedure are accompanied by a comparative review of harmonisation level of all proposal laws with appropriate provisions of the EU legislation, the Council of Ministers tasked the Directorate for European Integrations for follow-up actions.

The Council of Ministers of B-H was informed of a Conclusion from the 5th session of the House of Representatives of the Parliamentarian Assembly of B-H, held on July 14, 2011 (Recommendation from the CEC Report).

The Ministry of Human Rights and Refugees and Ministry of Civil Affairs are in charge for the realisation of the recommendation No. 5 from the Central Election Commission Report concerning the implementation of legislation within competences of the Central Election Commission of Bosnia and Herzegovina in 2011.

The Council of Ministers of B-H was informed of conclusions from the 6th session of the House of Representatives of the Parliamentarian Assembly of B-H, regarding a debate on reports of the Audit Office of Institutions of B-H on audit of financial operations of B-H Institutions in 2009.

The Ministry of Finance and Treasury is tasked to propose to the Council of Ministers regulations to govern the use of official vehicles, official trips, entertainment costs, office equipment supplies and, phone costs etc.

The Council of Ministers of B-H defined responses to the following deputies’ questions:

-          A response to deputy’s question of Nermin Purić, Deputy in the House of Rerpesentatives of B-H, upon a proposal of the B-H Foreign Investment Promotion Agency;

-          A response to deputy’s question of Lazar Prodanović, Deputy in the House of Representatives of B-H, upon a proposal of the Ministry of Foreign Affairs;

-          A response to deputy’s question of Mirsad Mešić, Deputy in the House of Representatives of B-H, upon a proposal of the B-H Food Safety Agency;

-          A response to deputy’s question of Šemsudim Mehmedović, Deputy in the House of Representatives of B-H, upon a proposal of the State Commission for Integrated Border Management;

-          A response to deputy’s question of Nermin Purić, Deputy in the House of Representatives of B-H, upon a proposal of the Directorate for European Integrations;

-          A response to deputy’s question of Nermin Purić, Deputy in the House of Representatives of B-H, upon a proposal of the Ministry of Finance and Treasury;

-          A response to deputy’s question of Nermin Purić, Deputy in the House of Representatives of B-H, upon a proposal of the Ministry of Civil Affairs;

-          A response to deputy’s question of Azra Hadžiahmetović, Deputy in the House of Representatives of B-H, upon a proposal of the Ministry of civil Affairs;

-          A response to deputy’s question of Azra Hadžiahmetović, Deputy in the House of Representatives of B-H, upon a proposal of the Ministry of Foreign Affairs;

-          A response to deputy’s question of Lazar Prodanović, Deputy in the House of Representatives of B-H, upon a proposal of the Ministry of Justice;

-          A response to deputy’s question of Nermina Zaimović, Deputy in the House of Representatives of B-H, upon a proposal of the Ministry of Foreign Trade and Economic Relations.

The Secretariat General of the Council of Ministers will provide the responses to deputy’s questions to the Parliamentarian Assembly of Bosnia and Herzegovina.

The Council of Ministers of B-H defined a Proposal Decision on ratification of the Amendment No. 1 of the Finance Contract between Bosnia and Herzegovina and the European Investment Bank, signed on November 17, 2005.

The Ministry of Foreign Affairs is in charge to provide the Proposal Decision to the B-H Presidency for its adoption.

The Council of Ministers of B-H adopted Information of the Ministry of Foreign Trade and Economic Relations on the status and issues of the Foreign Trade Chamber of Bosnia and Herzegovina, prepared upon a request of the House of Representatives Foreign Trade and Customs Policy Committee.

The Ministry of Foreign Trade and Economic Relations is in charge to provide the information to the Parliamentarian Assembly of B-H.

Also, the Council of Ministers suggests to the Parliamentarian Assembly to adopt a conclusion to launch a procedure for enactment of a law amending and supplementing the Law on Foreign Trade of B-H.

The Council of Ministers of B-H defined a text Readmission Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Turkey, together with Joint Official Minutes on Expert Talks between delegations of B-H and the Republic of Turkey, held in Ankara on July 18-19, 2011.

Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H took a Decision to appointment members of the Entrepreneurship Development and Promotion Forum in Bosnia and Herzegovina.

The Council of Ministers of B-H took a Decision amending the Decision on Appointment of Manager of the General Affairs Service of Institutions of Bosnia and Herzegovina and two Decisions amending the Decisions on Appointment of Deputy Mangers of the General Affairs Service in B-H Institutions.

The Council of Ministers of B-H is informed of an application form for entry visa issuance for persons from Kosovo, participants at the First Regional Conference on Cooperation towards Sustainable Tourism, organised by the USAID.    

In regard to that, and in compliance with the Conclusion from the 86th session of the Council of Ministers of May 7, 2009, taken in connection with a Position of the Presidency of B-H on the issue of legality of documents in possession of Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visas at a separate sheet for two persons, indicated in the application, for their participation at above Conference, to be held on September 20-21, 2011 for the period of the Conference.

The Secretariat General of the Council of Ministers is in charge to deliver the conclusion to the Ministry of Foreign Affairs for further procedure.

Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision allowing the current budget reserves funds to be earmarked to the Jewish Community in Bosnia and Herzegovina in amount of KM 15,000 for the purpose of marking the International Holocaust Remembrance Day.

The Council of Ministers of B-H is informed of the expiry of mandate of the acting manger of Indirect Taxation Administration.

In regard to that, the Council of Ministers of B-H reappointed Miro Džakula for acting manager of the Indirect Taxation Administration, for another 90 day period, as at August 25, 2011.

The Legislative Office of the Council of Ministers is tasked to prepare the Decision on Appointment.

The Council of Ministers of B-H suggested to the Presidency of B-H to present the position of Bosnia and Herzegovina identical to that of the European Union concerning the Resolution on Nuclear Potentials of Israel, on which the B-H Mission should come out at a Conference in Geneva, in early September. Such position is an obligation of Bosnia and Herzegovina, under the Stabilisation and Accession Agreement.

The Council of Ministers of B-H accepted a sponsorship over the International Festival of Folk Singing Societies to be held in Čapljina this year, and authorised the Minister of Finance and Treasury to attend the festival.
