Council of Ministers Holds its 166th Session

The proposer, Ministry of Finance and Treasury, will provide the Proposal Agreement to the Presidency of BIH for further procedure, and Minister of Finance and Treasury was proposed as the BIH signatory.
The Council of Ministers of BIH defined Proposal Basics for negotiations for conclusion of a Contract on Legal Assistance in Civil and Criminal Matters between Bosnia and Herzegovina and the Lebanon Republic.
The proposer, Ministry of Justice, will provide the Proposal contract to the Presidency of BIH for further procedure, and the Minister of Justice was proposed as the BIH signatory of the Contract.
The Council of Ministers of BIH defined a Proposal Contract on Loan (Brčko By-Pass Project) between Bosnia and Herzegovina and the European Bank for Reconstruction and Development.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Contract to the Presidency of BIH for further procedure, and Minister of Finance and Treasury was proposed as the BIH signatory.
The Council of Ministers of BIH defined Proposal Basics for negotiations for conclusion of an Agreement between Bosnia and Herzegovina and the International Agency for Nuclear Energy on application of protective measures concerning a contract on Non-Proliferation of Nuclear Weapons and Additional Protocol to the Agreement between Bosnia and Herzegovina and the International Agency for Nuclear Energy on Application of Protective Measures concerning the contract on Non-Proliferation of Nuclear Weapons.
The proposer, State Regulatory Agency for Radiation and Nuclear Safety, will provide the Proposal Basics to the Presidency of BIH for further procedure, and Manger of the State Regulatory Agency for Radiation and Nuclear Safety Emir Dizdarević was proposed as the BIH signatory of the Agreement.
The Council of Ministers of BIH considered Draft Basics for negotiations with the Islamic Community in Bosnia and Herzegovina for concluding a Basic Agreement between Bosnia and Herzegovina and eth Islamic Community in BIH.
In regard to that, the negotiating team will be comprised as follows:

The negotiating team, with a support of the Ministry of Human Rights and Refugees is responsible to seek a designation of four representatives of the Islamic Community in BIH in order to start negotiations.
The Council of Ministers of BIH defined Proposal Basics for negotiations on accession of Bosnia and Herzegovina to the Convention on Cross-Border Effects of Industrial average.
The proposer, Ministry of Foreign Trade and Economic Relations, will provide the Proposal Basics to the Presidency of BIH for further procedure.
The Council of Ministers of BIH defined individual proposal decisions on ratification of international treaties as follows:
- Proposal Decision on ratification of a Financing Agreement between Bosnia and Herzegovina and the European Commission on IPA Adriatic Programme of Cross-Border cooperation within the Instrument of Pre-Accession Assistance;
- Proposal Decision on Ratification of an Agreement between Bosnia and Herzegovina and Ireland on Double Taxation Avoidance and Prevention of Fiscal Evasion in Respect to Income Tax and Tax on Gains from Property;
- Proposal Decision on Ratification of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Council of Ministers of the Republic of Albania on Double Taxation Avoidance in Respect to Income Tax and Tax on Gains from Property and Prevention of Fiscal Evasion;
- Proposal Decision on Ratification of an Agreement between Bosnia and Herzegovina and Malaysia on Double Taxation Avoidance and Prevention of Fiscal Evasion in Respect to Income Tax;
- Proposal Decision on Ratification of an Agreement between Bosnia and Herzegovina and the Greek Republic on Double Taxation Avoidance and Prevention of Fiscal Evasion in Respect to Income Tax and Property Tax;
- Proposal Decision on Ratification of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Hashemite Kingdom of Jordan on Double Taxation Avoidance and Prevention of Fiscal Evasion in Respect to Income Tax;
- Proposal Decision on Ratification of a Joint Convention on Safe Storing of Used Fuel and Safe Storing of Radioactive Waste.
The proposer, Ministry of Foreign Affairs, will provide proposal decisions to the Presidency for adoption.
The Council of Ministers of BIH considered and adopted Information of the Ministry of Communications and Transport on a Resolution of the Appeals Office of Bosnia and Herzegovina on Annulment of Public Procurement Procedure for Digital Microwave Links for joining five information-technical centres into digital links and receivers system for the coverage of Sarajevo, Mostar and Banja Luka with digital signal.
Upon a proposal of the Ministry of Justice, the Council of Ministers of BIH took a Decision on Amendments of a Decision on criteria for defining reimbursement levels for engagement in managing boards, steering and other boards and work bodies within the competence of Institutions of Bosnia and Herzegovina, with amendments adopted at the session.
Also, the Council of Ministers of BIH tasked all institutions to provide information, within 15 day deadline, on payments of reimbursements to all committees, managing, steering and other Boards and other bodies within the competences of Institutions of BIH, and to submit reports to the Secretary General o for completion of required Information.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers took a Decision on granting its consent to accepting Mahir Hadžiahmetović for an Honorary Consul of Brazil in Bosnia and Herzegovina and opening of Honorary Consular Office of Brazil in Bosnia and Herzegovina, with the seat in Sarajevo.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers took a Decision on granting its consent to accepting Mirza Durmišević for an Honorary Consul of the Kingdom of Denmark in Bosnia and Herzegovina and opening of Honorary Consular Office of the Kingdom of Denmark in Bosnia and Herzegovina, with the seat in Sarajevo.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers took a Decision on appointing Giuseppe Castellano for an Honorary Consul of Bosnia and Herzegovina in the Republic of Italy, and on granting consent to opening of the Honorary Consular Office of Bosnia and Herzegovina in the Republic of Italy, with the seat in Enna.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers took a Decision on appointing Mehmet Cevik for an Honorary Consul of Bosnia and Herzegovina in the Republic of Turkey, and on granting consent to opening of the Honorary Consular Office of Bosnia and Herzegovina in the Republic of Italy, with the seat in Kocaeli.
The Council of Ministers of BIH took a Decision on approving the allocation of the BIH Budge reserves funds in amount of KM 180.000,00 to the Court of BIH for Bosnia and Herzegovina’s share in the project of reconstruction of the existing facilities for the purpose of capacities extension (building-up of the BIH Judiciary Institutions building - block 100).
The Council of Ministers of BIH received Information from the Agency for Civil Service on the expiry of mandate to managing civil servant Jovan Šarac, Secretary with Special Task in the Institute for Intellectual Property of Bosnia and Herzegovina.
In regard to that, and pursuant to Article 34 of the Law on Civil Service in BIH Institutions, the mandate of Jovan Šarac at the post of Deputy Director of the Agency for Intellectual Property has been renewed, starting from Dec. 28, 2011.
Upon a proposal of the Ministry of Security, the Council of Ministers of BIH issued a resolution appointing Tihomir Maričić as Deputy Manager of the Agency for Police Support.
Also, all Ministries are obliged to accompany their appointment proposals with CVs of candidate managers.
Upon a proposal of the Ministry for Foreign Trade and Economic Relations, the Council of Ministers of BIH issued a resolution appointing Hamdija Ćivić as Acting Manager of the Office for Payment System Harmonisation and Coordination in Agriculture, Food Industry and Rural Development of BIH.
The Council of Ministers of BIH considered a proposal rank list of the most successful candidates, delivered by the Public Procurement Agency, and in regard to that appointed members of the Agency Board as follows: Ostoja Travar, Meliha Jahjaefendić, Mirko Lončar and Dženana Selimović.
Upon a proposal of the Independent Committee for Selection of the Civil Service Appeals Committee, the Council of Ministers of BIH appointed the following members of the Civil Service Appeals Committee: Feliks Vidović, Branka Kolar-Mijatović, Aida Žilić.
The Council of Ministers of BIH appointed Samir Omerhodžić for Manger of the Insurance Agency of Bosnia and Herzegovina.
The Council of Ministers of BIH reappointed Miro Džakula for Acting Manger of the Indirect Taxation Administration of BIH for 90 period of time, starting from November 23, 2011.
The Council of Ministers of BIH considered a Report of the High Judicial and Prosecutorial Council on Activities of the Supervisory Board for Implementation of the State Strategy for Work on War Crimes Files for the time period of Jan.1- Sep. 30, 2011, with the proposed conclusions contained in it.
The Council of Ministers of BIH considered the Second Report of Bosnia and Herzegovina on Application of the European Social Chart (revised), Articles 1, 9, 20 (section I: employment, training and equal chances) for the referent period of Jan.1, 2008 – Dec. 31, 2011, with the proposed conclusions contained in it.
Upon a proposal of the Ministry of Security, the Council of Ministers of BIH took a Decision on implementation of restrictive measures defined under the following UNSC resolutions: 1267 (1999), 1333 (2000), 1363 (2001), 1373 (2001), 1390 (2002), 1452 (2002), 1455 (2003), 1562 (2004), 1617 (2005), 1735 (2006), 1822 (2008), and 1904 (2009) against members of Al-Qaida, Osama bin Laden and Taliban and other individuals, groups, business entities and organisations affiliated to them, and adopted proposals presented at the session.
The Council of Ministers of BIH adopted a Proposal Assessment of justifiability of participation of BIH police force members in the transformed UNMIS Mission in Sudan (South Sudan) and UNISEFA Mission (Abeyei).
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of BIH granted its consent to appointment of Colonel Marcel Eduard Pooley Liscombe as a Military Attaché of Chile for Bosnia and Herzegovina, with the seat in Budapest.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of BIH granted its consent to appointment of Colonel Petar Anatolijevič Bobyar as a Military Attaché of Ukraine for Bosnia and Herzegovina, with the seat in Zagreb.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of BIH granted its consent to appointment of Colonel Robbert Jan Verbrugh as a Military Attaché of the Kingdom of Netherlands for Bosnia and Herzegovina, with the seat in Budapest.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of BIH granted its consent to appointment of Colonel Ivan Vladimirovič Popov as a Military Attaché of the Russian Federation for Bosnia and Herzegovina, with the seat in Sarajevo.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of BIH granted its consent for vote to citizens of the Russian Federation in Bosnia and Herzegovina at the Parliamentarian elections on December 4, 2011, in the premises of the Russian Embassy in Bosnia and Herzegovina in Sarajevo and in Banja Luka in the “Optima grupa” d.o.o. building, in time between 8.00 and 20.00 hrs.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of BIH granted its consent for vote to citizens of the Republic of France in Bosnia and Herzegovina in the premises of the Embassy of the Republic of France in Sarajevo at the Presidential and Parliamentarian elections to be held on April 22, 2012 and May 6, 2012 and on June 3, 2012 and June 17, 2012, respectively.
The Council of Ministers of BIH did not come out on a request of the Presidency of Bosnia and Herzegovina for offering medical assistance to Libyan citizens in Bosnia and Herzegovina, concluding that the same was delivered by the Secretariat of the Presidency, and that in relation to this request, relevant conclusions from the Presidency session were not submitted for consideration of the subject matter.
The Presidency was requested to provide its conclusions on this issue.
The Council of Ministers of BIH defined answers to deputies’ questions as follows:
- answers of the Ministry of Foreign Trade and Economic Relations to deputies’ questions of Nermina Ćemalović and Zijad Jagodić, Deputies in the House of Representatives of the Parliamentarian Assembly of BIH.
- answer of the Secretariat General of the Council of Ministers of BIH to a deputy’s question of Mirsad Đuhum, Deputy in the House of Representatives of the Parliamentarian Assembly of BIH; and
- answer of the Ministry of Communications and Transport to a delegate’s question of Mehmed Bradarić, Delegate in the House of Peoples of the Parliamentarian Assembly of BIH.
The Secretariat General of the Council of Ministers is in charge to provide the answers to the Parliamentarian Assembly of BIH.
In compliance with a conclusion of the Council of Ministers from its 86th session of May 7, 2009, adopted in relation with a Position of the Presidency of BIH regarding the issue of legality of documents in possession of Kosovo citizens, the Council of Ministers authorised the Ministry of Foreign Affairs to issue entry visas on a separate sheet as follows:
