Council of Ministers of B-H Holds Its 165th Session

The Council of Ministers accepts the concluding of the Implementation Agreement and authorises Public Administration Reform Coordinator Semiha Borovac for its signing.
Also, The Public Administration Reform Coordinator Office is tasked to secure the following during the implementation of the Agreement:
a) Credible implementation of the Public Administration Reform Strategy and implementation of reform measures defined under the Action Plan 1;
b) Definition of goals and activities for strengthening of organisation and human potentials in identified institutions, i.e. Central Bank of B-H, Statistics Agency, Agency for Preschool, Primary and Secondary Education, Public Procurement Agency, and in other institutions to be identified subsequently.
Also, it was concluded that the Public Administration Reform Coordinator Office should provide annual reports on implementation of the Agreement to the Council of Ministers of B-H for consideration, in addition to transmitting them to the Parliamentarian Assembly and Presidency of B-H.
The Council of Ministers of B-H defined a Proposal Implementation Protocol between the Council of Ministers of Bosnia and Herzegovina and Government of Romania for the Agreement between the European Community and Bosnia and Herzegovina on Readmission of Persons Non-Holders of Stay Permits, and adopted a Report on negotiations.
The proposer, Ministry of Security, will provide the Proposal Implementation Protocol to the Presidency of B-H for further procedure, and the Minister of Security is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined a Proposal Memorandum of Understanding between the Council of Ministers of Bosnia and Herzegovina and Government of Liechtenstein on setting-up a migration partnership between Bosnia and Herzegovina and Liechtenstein.
The proposer, Ministry of Security, will provide the Proposal Implementation Protocol to the Presidency of B-H for further procedure, and the Minister of Security is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined a Proposal Loan Contract between Bosnia and Herzegovina and the European Bank for Reconstruction and Development titled Sarajevo – Project of City Roads, and its along basics for its conclusion.
The proposer, Ministry of Finance and treasury, will provide the Proposal Contract to the Presidency of B-H for further procedure, and the Minister of Finance and Treasury is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined Proposal Basics for negotiations on an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of San Marino on International Road Transport of Passengers and Goods.
The proposer, Ministry of Communications and Transport will provide the Proposal Basics to the Presidency of B-H for further procedure, and the Minister of Communications and Transport is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined Proposal basics for conclusion of a Supplement to a Finance Agreement between Bosnia and Herzegovina and Commission of European Community for Nuclear Safety Horizontal Programme and Protection from Radiation within the Instrument of Pre-Accession Assistance for 2008.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Basics to the Presidency of B-H for further procedure, and the Minister of Finance and Treasury is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined a Proposal Amendment of an Agreement concerning the Loan and Project Agreement of March 22, 2010, concluded between the KfW, Frankfurt am Main, Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury (Borrower), Federation of Bosnia and Herzegovina, represented by the Federal Ministry of Finance, and Public Company Elekroprivreda Hrvatske Zajednice Herceg-Bosne (Project Implementation Agency) for Mesihovina Wind Mills, with its basics for conclusion.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Basics to the Presidency of B-H for further procedure, and the Minister of Finance and Treasury is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined Proposal Basics for negotiations for conclusion of an Agreement between the Council of Ministers of Bosnia and Herzegovina and the Principality of Monaco on Bilateral Cooperation in Tourism.
The proposer, Ministry of Foreign Trade and Economic Relations, will provide the Proposal Basics to the Presidency of B-H for further procedure, and the Minister of Foreign Trade and Economic Relations is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined Proposal Basics for negotiations for signing of a Memorandum of Understanding between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Croatia on Cooperation in Environment Protection and Sustainable Development.
The proposer, Ministry of Foreign Trade and Economic Relations, will provide the Proposal Basics to the Presidency of B-H for further procedure, and the Minister of Foreign Trade and Economic Relations is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined Proposal Basics for negotiations for conclusion of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Azerbaijan on visa lifting for holders of diplomatic and service passports.
The proposer, Ministry of Foreign Affairs, will provide the Proposal Basics to the Presidency of B-H for further procedure, and the Minister of Foreign Affairs is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined Proposal Basics for negotiations for conclusion and signing of Annex III to a Memorandum of Understanding for Establishment of a Fund for Public Administration Reform between the Oversees Development Agency of the United Kingdom, Swedish International Development Agency, Ministry of Development and Cooperation of Netherlands, Delegation of EU in B-H and Council of Ministers of Bosnia and Herzegovina, Government of Federation of B-H, Government of Republika Srpska, Government of Brčko District and Ministry of Finance and Treasury of B-H.
The proposer, Public Administration Reform Coordinator Office, will provide the Proposal Basics to the Presidency of B-H for further procedure, and Chairman of the Council of Ministers Dr. Nikola Špirić is proposed as B-H signatory of the document.
The Council of Ministers of B-H defined Proposal Basics for negotiations for conclusion of a Contract on Extradition between Bosnia and Herzegovina and the People’s Republic of China.
The proposer, Ministry of Justice, will provide the Proposal Basics to the Presidency of B-H for further procedure, and the Minister of Justice is proposed as B-H signatory of the Contract.
The Council of Ministers of B-H defined the following individual proposal decisions on ratification of international treaties:
- Proposal Decision on Ratification of a Loan Agreement for Main City Highway in Zenica between the Saudi Fund for Development and Bosnia and Herzegovina;
- Proposal Decision on Ratification of an Agreement on Grant by Swedish Trust Fund (Water Quality Project: Water Supply and Sanitation in Mostar) between Bosnia and Herzegovina and the International Bank for Reconstruction and Development, as administrator of the Swedish Trust Fund.
The proposer, Ministry of Foreign Affairs, will provide the Proposal Basics to the Presidency of B-H for their adoption.
The Council of Ministers of B-H considered and accepted an Initiative for negotiations for conclusion of a Loan Contract for the Plava Voda (Blue Water) Regional Water Supply Project between Bosnia and Herzegovina and the European Bank for Reconstruction and Development (EBRD).
In regard to that the following negotiating delegation was designated:
- Minister of Finance and Treasury or authorised persons – head of negotiating team;
- Minister of Finance of Federation of B-H, or authorised persons; and
- Heads of Municipalities, or authorised persons
Following the negotiations, the Ministry of Finance and Treasury will act in compliance with Article 39 of the Law on Borrowing, Debt and Guarantees of Bosnia and Herzegovina (“Official Gazette of B-H”, Nos. 52/05 and 103/09), and will provide a Draft Contract and Basics for its Conclusions to the Council of Ministers for adoption.
The Council of Ministers of B-H considered and adopted a Report from a meeting the Joint Committee for Implementation of the Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Monte Negro on Transport of Passengers and Cargo in International Road Transport, and the signed-to Protocol from the meeting is a part of the Agreement.
Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H took a Decision on ban of import in and export from Bosnia and Herzegovina of certain deliveries for the reason of prevention of the classic swine flu.
Upon a proposal of the Ministry of Finance and Treasury, the Council of Ministers of B-H took a Decision on Amendment of the Decision on Setting-Up a Committee for Salaries and Reimbursements in Institutions of Bosnia and Herzegovina.
Upon a proposal of the Ministry of Finance and Treasury, the Council of Ministers of B-H took a Decision on Amendment of the Decision on Appointment of members of a Committee for Salaries and Reimbursements in Institutions of Bosnia and Herzegovina, replacing the Committee member Zlatko Akšamija by Neven Akšamija.
Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision on Amendment of the Decision on Level of Reimbursements for Engagement in the Council of Science of Bosnia and Herzegovina.
Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H took a Decision on a ban of import in and export from Bosnia and Herzegovina of certain deliveries for the reason of prevention of the herpes virus.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of B-H took a Decision on Termination of Mandate of Honorary Consul of Bosnia and Herzegovina in the Republic of ;Macedonia Vera Blagojević.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of B-H took a Decision on Termination of Mandate of Honorary Consul of Bosnia and Herzegovina in the Republic of Hungary Đerđ Terek.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of B-H took a Decision on Appointment of Ronny Kobrovski as the Honorary Consul of Bosnia and Herzegovina in Israel and on Granting its Consent for Opening of the Honorary Consulate Office of Bosnia and Herzegovina in Israel in Tel Aviv.
The Council of Ministers of B-H considered and adopted Information of the Directorate for Economic Planning on Development on 2012 Economic-Fiscal Programme, with proposed conclusions and with correction of deadlines defined in the proposed conclusions (under 4 and 5).
The Council of Ministers of B-H considered and adopted Information of the Ministry of Security on an International Civil Protection Exercise in Slovenia this October, with proposed conclusions.
The Council of Ministers of B-H considered and adopted Information of the Ministry of Security on the 1st meeting of the Standing Joint Committee for Implementation of the Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Macedonia on Cooperation in Protection from Natural and Man-Made Catastrophes.
In regard to that the Ministry of Security is in charge to implement both the agreed activities together and preparations for organisation of the 2nd meeting of the Standing Joint Committee to be held in Bosnia and Herzegovina in 32012.
The Council of Ministers of B-H did not come out on Proposal Regulations on Implementation of Restrictive Measures Defined under the UN Security Council resolutions 1267 (1999), 1390 (2002), 1452 (2002), 1455 (2003), 1526 (2004), 1617 (2005), 1735 (2006), 1822 (2008),a nd 1904 (2009) against members of Al-Qaida, Osama bin Laden, Taliban and other individuals and groups, business entities and organisations affiliated to them.
The Council of Ministers of B-H appointed Aner Hadžiahmetović, from the Ministry of Security, for a new member of the Steering Body for Monitoring of Implementation of State Strategy for Work on War Crime Files, to replace Sead Lisak.
The Council of Ministers of B-H granted its consent to the representative of the Council of Ministers B-H before the European Court for Human rights to accept and sign, on behalf of Bosnia and Herzegovina, amicable reconciliation perpared by the European Court for Human Rights in respect to 37 applications under the case Arežina and 59 others against Bosnia and Herzegovina.
Upon a proposal of the Ministry of Finance and Treasury, the Council of Ministers of B-H adopted a methodology for deployment of employees within salary classes.
Upon a proposal of the Ministry of Security, the Council of Ministers of B-H took a decision on release from duty of Dragan Slipac Deputy Manager of the Agency for Police Support, on his own request.
The Council of Ministers of B-H considered and adopted Information of the Ministry of Civil Affairs concerning a request of the General National Museum for ensuring the central heating for the 2011-2012 season.
In regard to that, the General Affairs Service of the Institutions of B-H was charged to undertake needed activities in order to join the heating facilities of the General National Museum to the central heating system of the Institutions of B-H for the 2011-2012 season.
The Council of Ministers of B-H was informed on a termination of mandate of managing civil servants: Drago Nedić Manager, Dragan Čobanov Deputy Manager, and Sanin Tanković Secretary, all holding posts of Secretary with Special Assignments in the Veterinary Office of Bosnia and Herzegovina.
In regard to that, the B-H Agency for Civil Service was charged to publish a job competition for filling of mentioned posts in the Veterinary Office of B-H.
The Council of Ministers of B-H considered and adopted Information of the Directorate for European Integrations on assessment of implications of the Republic of Croatia’s accession to the EU, with the proposed conclusions and recommendations presented at the session.
The Council of Ministers of B-H considered and adopted Information of the Directorate for European Integrations on a full enlargement package and key recommendations of the European Commission for Bosnia and Herzegovina.
The Council of Ministers of B-H considered and adopted Information of the Directorate for European Integrations on adoption of a Multi-Beneficiary IPA 2011 Programme under the Support in Transition and Institutional Development Component.
In regard to that the head of the directorate for European Integrations is authorised to send a letter to the European Commission confirming the agreement to the Multi-Beneficiary IPA 2011 Programme under the Component Support in Transition and Institutional Development.
The Council of Ministers of B-H did not come out on a Joint Report of the Monitoring Committee for Residential Institutions for Accommodation and Care of Children, Victims of Violence and Human Trafficking, Asylum Seekers, Illegal Immigrants, Refugees, Elders and Disabled Persons and other institutions, as appropriate, for 2010.
The Council of Ministers of B-H received a Report on Visit to Bosnia and Herzegovina of the European Committee for Prevention of Torture, Inhumane and Humiliating Treatment or Punishment (CPT), sent to the Council of Ministers of Bosnia and Herzegovina. In regard to that it concluded the following:
- The Report on visit to Bosnia and Herzegovina of the European Committee for Prevention of Torture, Inhumane and Humiliating Treatment or Punishment (CPT), sent to the Council of Ministers of Bosnia and Herzegovina is adopted; the Report requires that the competent institutions of B-H fill in a response to Report recommendations within six months, focused on activities taken during its implementation;
Bosnia and Herzegovina authorities are obliged to deliver reactions to the CPT commentaries and requests for information sent by the CPT;
The Ministry for Human Rights and Refugees, as activity coordinator, is obliged to draft a report of B-H authorities, following the third periodic CPT visit to Bosnia and Herzegovina, and provide it to the UN Committee against Torture.
The Council of Ministers of B-H considered and adopted a Report of the Ministry of Foreign Trade and Economic Relations on implementation of a Road Map for Improvement of Conditions for Export of Products of Animal and Herbal Origin.
Also, the Council of Ministers of B-H concluded that an urgent implementation of activities from the Report is required, especially those referred to in the Road Map under 1 and 4, in order to prepare the implementation of the priority activities to be undertaken by competent institutions in the food network.
The Council of Ministers of B-H considered and adopted a Report of the Ministry of Civil Affairs on mine action in Bosnia and Herzegovina in 2010.
The Council of Ministers of B-H considered and adopted a Report of the Ministry of Civil Affairs on situation in high education and implementation of the Framework Law on High Education in Bosnia and Herzegovina, with the proposed conclusions.
The Council of Ministers of B-H took Regulations Amending the Regulations on Marking and Movement Control of Animals.
The Council of Ministers of B-H took Regulations Amending the Regulations on Measures for Detection, Suppression and and Extermination of the Swine Flu.
The Council of Ministers of B-H took Regulations on Defining Diagnostic Procedures, Methods of Samples Taking and Criteria for Laboratory Tests Verification for the Swine Vesicular Illness.
The Council of Ministers of B-H took Regulations on Additional Guarantees for Estates in Respect to Transmissive Spongiform Encephalopatia.
Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H defined an Opinion concerning an authentic interpretation of provisions of the Law on Customs Policy of Bosnia and Herzegovina, to be submitted to the House of Peoples of the Parliamentarian Assembly of B-H.
The Ministry of Foreign Trade and Economic Relations is tasked to deliver the Opinion to the Parliamentarian Assembly of B-H.
Upon a proposal of the Ministry of Communications and Transport, the Council of Ministers of B-H defined an Opinion concerning an authentic interpretation of Article 78 paragraph (1) of the Law on Security Principles on Roads in Bosnia and Herzegovina, submitted by the Ministry of Education and Science of the Sarajevo Canton.
The Ministry of Communications and Transport is tasked to provide the Opinion to the Parliamentarian Assembly of B-H.
Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H adopted its Opinion on Legislative Procedure for a Proposal Law on Amendments and Supplements to a Law on Identity Card of Citizens of Bosnia and Herzegovina, submitted by the House of Representatives of the Parliamentarian Assembly of B-H.
The Ministry of Civil Affairs is tasked to provide the Opinion to the Parliamentarian Assembly of B-H.
The Council of Ministers of B-H did not come out on a Proposal Opinion of the Ministry of Justice on a Proposal Law on Ban of Negation, Minimising, Justicficati0n of Holocaust, Crimes of genocide and Crimes against Humanity.
The Council of Ministers of B-H received information on conclusions the House of Peoples of the Parliamentarian Assembly of B-H, adopted at its 6th session of September 30, 2011, regarding a discussion on a Report on Agriculture in B-H for 2010, and tasked the Ministry of Foreign Trade and Economic Relations for its implementation.
Also, The Council of Ministers received information on a conclusion of the House of Peoples of the Parliamentarian Assembly of B-H, adopted at its 6th session, concerning granting of consent for ratification of a Loan Agreement for the “East Sarajevo University Modernisation Project” between Bosnia and Herzegovina and Raiffesisen Bank International AG.
In regard to that, the Ministry of Foreign Affairs is tasked to prepare for the Council of Ministers a complete report on reasons for delay of ratification of mentioned Agreement.
Upon proposals of line Ministries, the Council of Ministers of B-H defined responses to Deputy’s questions as follows:
- answers to questions by Zijad Jagodić and Petar Kunić, Deputies in the House of Representatives of the Parliamentarian Assembly of B-H, upon a proposal of the Ministry of Justice;
- answers to questions by Danijela Martinović and Ismeta Dervoz, Deputies in the House of Representatives of the Parliamentarian Assembly of B-H, upon a proposal of the Ministry of Foreign Trade and Economic Relations;
- answers to questions by Denis Bećirović (two responses), Niko Lozančić, Nermina Zaimović-Uzunović (two responses), and Beriz Belkić, Deputies in the House of Representatives of the Parliamentarian Assembly of B-H, upon a proposal of the Ministry of Civil Affairs;
- answers to a Deputy’s initiative by Saša Magazinović, Deputy in the House of Representatives of the Parliamentarian Assembly of B-H, upon a proposal of the Ministry of Communications and Transport;
- answers to questions by Zijad Jagodić, Halid Genjac and Mirsad Mešić, Deputies in the House of Representatives of the Parliamentarian Assembly of B-H, upon a proposal of the Ministry of Communications and Transport;

The Council of Ministers of B-H also agrees to an answer to a question posed by Niko Lozančić, Deputy in the House of Representatives of the Parliamentarian Assembly of B-H, defined by the Ministry of Civil Affairs.
The Secretariat General of the Council of Ministers of B-H is tasked to provide the respective responses to the Parliamentarian Assembly of B-H.
