DRAFT LAW ON FOREIGNERS DEFINED 

The Council of Ministers of BIH defined at its 16th session in Sarajevo, a Proposal Law on Foreigners, with a mark “E”, as a proof of adequate level of alignment with relevant legislative of the European Union.

The Proposal Law, harmonised with 10 Directives and 11 decrees of the European Union, regulate the process of entry of foreigners to BIH, visa and non-visa regime, travel documents for foreigners, stay of foreigners and their taking away form BIH, admission and placing into custody.

This comprehensive piece of legislation contains 146 articles arranged into nine chapters, and its adoption should solve the issue of migration flows to Bosnia and Herzegovina more endurably and effectively, with a full consideration of int4rnatioanl norms and BIH realities.

Other than BIH institutions, the development of the legislation included international experts and NGO sector in BIH.

The Ministry of Security will provide the Proposal Law to the Parliamentarian Assembly of BIH for consideration, under regular legislative procedure.

 

BIH SECURES STRATEGIC IMPLEMENTATION OF CoE CONVENTION ON DOMESTIC AND VIOLENCE AGAISNT WOMEN

 

In line with its obligations taken under a Convention on Prevention and Fight against Violence against Women and Domestic Violence of the Council of Europe, ratified by the Parliamentarian Assembly of BIH in 2013, the Council of Ministers took a Decision on adoption of a 2015-2018 Framework Implementation Strategy of Convention on Prevention and Fight against Violence against Women and Domestic Violence in Bosnia and Herzegovina.

The Strategy adoption was initiated by the Ministry for Human Rights and Rrefugees for the purpose of securing a consistent, high quality and effective implementation of the CoE Convention by relevant institutions.

The Gender Equality Agency of BIH is tasked to report on the Framework Strategy implementation to the Council of Ministers od BIH and relevant parliamentarian Committees on.

All competent institutions are tasked to get actively involved in the realisation of planned activities under the Framework Implementation Strategy of on Prevention and Fight against Violence against Women and Domestic Violence in Bosnia and Herzegovina.

The Strategy includes a set of measures to be implemented by competent authorities by 2018 for achieving four strategic aims, namely: securing comprehensive, efficient and inclusive domestic violence prevention against women; arranging a multidisciplinary and coordinated protection system for victims of domestic and violence against women, in line with the Council of Europe Convention; improving conditions for sanctioning of perpetrators of domestic and violence against women and securing improved access to justice for victims;  improvement of monitoring framework for integrated and gender-sensitive policies for prevention and fight against violence against women and domestic violence.

The Convention on Prevention and Fight against Violence against Women and Domestic Violence was adopted on May 11, 2011 in Istanbul, and by its adoption on November 7, 2013 BIH became the 6th CoE member country to ratify it.

 

CoM ALLOCATES KM 0.5 FOR PROMOTION OF DOMESTIC PRODUCTION IN 2015

The Council of Ministers of BIH took a decision on criteria for allocation of current grants approved to the Ministry of Foreign Trade and Economic Relations of BIH for support for fair and other events in country and abroad for the need of promotion of domestic production in 2015.

Out of total approved KM 500,000 for organisation of domestic production promotion fairs and other events, KM 200,000 were approved for the promotion purposes in country, and KM 300,000 for support to promotion in fairs and other events abroad.

The right to funds is to organisers with years of experience in fair organisation, organisers of fair events of international character, and organiser to promoting domestic production at fair events. To apply for fund, organisers need to fill a written declaration of reducing the participation costs to domestic companies, pursuant to the grant funds they receive.

 

TO SOLVE ISSUES OF BIH CONLTURAL INSTITUTIONS

 

The Council of Ministers  of BIH took note of issues of a number of cultural institutions of special importance for Bosnia and Herzegovina, and concluded that the Council of Ministers of BIH and competent Ministry of Civil Affairs should engage in addressing their issues.

The Council granted its consent to he Ministry of civil Affairs of BIH to get engaged in solving the current and status issues (administrative, managerial and financial ones) of these institutions, in cooperation with competent State, Entity and cantonal Ministers of Culture and other public stakeholders in BIH.

The considered subject information covered the General Museum of Bosnia and Herzegovina, Historic Museum of Bosnia and Herzegovina, national and University Library of Bosnia and Herzegovina, Literature and Theatre Museum of Bosnia and Herzegovina, Library for Blind and Visually Disabled Persons of Bosnia and Herzegovina, Cinematheque of Bosnia and Herzegovina, and Art Gallery of Bosnia and Herzegovina.

 

BIH CoM SECURES STRONGER COMPETITION FOR MENAGERIAL POSITIONS

 

The Council of Ministers of BIH, upon a proposal of the Ministry of Justice, took a Decision on amendments of the Decision on classification of work posts and criteria for work posts in the Institutions of Bosnia and Herzegovina, in order to enable stronger public competition in job vacancy procedure for managerial staff in the BIH Intuitions, thus creating conditions for selection of high quality staff.

The Amendment Decision prescribes at least five years of experience in the same profession, out of which four at managerial position for applicants for position of  institution manager, deputy manager or secretary with special assignment.

Also, individual consents were given for amendments of rulebooks of internal organisation of all institutions and bodies of the Council of Ministers of BIH, to include these conditions, while BIH competent institutions are tasked to publish job vacancies for selection of managers, whose mandates expired or to expire soon,  for the timely filling of the vacancies.

 

BIH DEMINING COMMITTEE APPOINTED

 

The Council of Ministers, upon a proposal of the Ministry of Civil Affairs, took a decision on appointment of Suvad Džafić, Blažen Kovač nd Mladen Mrkaja for members of the BIH Demining Committee for a two-year mandate.

 

APPOINTED ACTING MANAGER AND COUNCIL OF BIH AGENCY FOR AIR NAVIGATION SERVICES

 

The Council of Ministers of BIH took a resolution, upon a proposal of the Ministry of Communications and Transport, on appointing Davorin Primorac for acting Manager of the BIH Agency for Air Navigation Services, for the purpose of enabling smooth operation of the Agency. Primorac will serve the duty until the completion of appointment procedure of the Agency Manager under a job vacancy procedure started in compliance with the law on BIH Agency for Air Navigation Services.

Also upon a proposal of the Ministry of Communications and Transport, the Council of Ministers of BIH took a decision on appointment of the Council of the BIH Agency for Air Navigation Services, which is to public, within a 15-day deadline an ad for selection and appointment of the BIH Agency for Air Navigation Services Management Board.

 

BIH SUSTAINS ITS NEGOTIATING POSITION

 

The Council of Ministers of BIH adopted the Directorate for European Integrations-proposed Report from May 29, 2015 Brussels meeting of BIH and European Commission Delegations for conclusion of a Protocol to Provisional Agreement on Trade and Trade Issues between the European Community, on one side, and BIH, on the other side, for the needs of accommodating the fact of the Republic of Croatia’s accession to the European Union (EU).The Council of Ministers maintains its negotiating position along with the mandate BIH Delegation received for the negotiations purposes, with a full consideration of the Stabilisation  and Accession Agreement, which does not provide for a term of traditional trade.

The Directorate for European Integrations of BIH is tasked to notify Entity Governments and the Brčko District Government on the current state of affairs with the negotiations and the reasons for which Bosnia and Herzegovina is not to give up from its negotiation position

The BIH negotiating delegation is tasked to inform the BIH Presidency accordingly, and the Directorate for European Integrations of BIH is tasked to implement the adopted conclusions.

These conclusions were made after the Council of Ministers of BIH got informed that Bosnia and Herzegovina and the European Union failed, even after three rounds of negotiations, to reach mutually acceptable solution on conclusion of the Protocol to the Provisional Agreement on Trade and Trade Issues, which would take into consideration the accession of the Republic of Croatia to the EU.

Bosnia and Herzegovina offered a compromise on a mutual increase of customs quotas for sugar, fish and vine, and furthermore BIH was ready to approve an increase of customs quotas from the Provisional Agreement Annex III for quantities of average three-year import of the subject goods to Bosnia and Herzegovina from Croatia, made in 2009-2011.

The session reiterated that Bosnia and Herzegovina wishes to arrive at a solution satisfying the interests of both Bosnia and Herzegovina and the European Union.

 

CONDITIONS MET FOR OPERATION OF ANTI-CORRUPTION AGENCY

 

The Council of Ministers of BIH adopted a Rulebook on Internal Organisation of the Agency for Fight against Corruption and Prevention of Corruption, thus creating material-technical and staff preconditions for the beginning of operation of the Agency, in compliance with the Law on Agency.

This is a fulfilment of obligation stemming from the Law on protection of Whistle Blowers reporting corruption in the BIH Institutions not only as concerns Law implementation monitoring, but also for providing for fulfilment of one of legal competences, acting against corruption reports and whistle blower protection.

 

ADMISION OT BIH CITIZENSHIP

 

The Council of ministers of BIH took individual decisions on admission to citizenship of Bosnia and Herzegovina of: Hazim Omerbašič, a businessman citizen of the Republic of Croatia; and; Miloš Golić, citizen of Montenegro and Bosnia and Herzegovina and national competitor in Thailand boxing; and Maria Zgonjaninovva, citizen of Slovakia, for her contribution to promotion of cooperation between BH and Slovakian businessmen.
