The Council of Ministers of B-H defined a Proposal Agreement between Bosnia and Herzegovina and the Kingdom of Spain on Cooperation in Fight against Crime, Especially Terrorism, Illicit Trade with Drugs and Organised Crime. 

The Proposer, Ministry of Security, will provide Proposal Agreement to the Presidency of Bosnia and Herzegovina, and Minister of Security of B-H is proposed for the signatory on behalf of B-H.

The Council of Ministers of B.H defined Proposal Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Croatia on construction of interstate bridge on River Sava Near Gradiška and border connection sections to the inter-state road E-661, and adopted a Report on the negotiations held.

The proposer, Ministry of Transport and Communications, will provide the Proposal to the Presidency of B-H for further procedure, and Minister of Transport and Communications is proposed for the signatory on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Memorandum of Understanding on Area of Archaeology between the Council of Ministers of Bosnia and Herzegovina and Government of the Arabic Republic of Egypt.

The proposer, Ministry of Civil Affairs, will provide the Proposal Memorandum to the Presidency for further procedure, and Minister of Civil Affairs is proposed for the signatory on behalf of B-H.

The Council of Ministers defined Proposal Basis for Signing of Declaration on Intent between the International Centre for Migration Policy Development (ICMPD) and Ministry of Security of B-H.

The proposer, Ministry of Security, will provide the Proposal Basis to the Presidency of B-H for further procedure, and Minister of Civil Affairs is proposed for the signatory on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for Conclusion of a Financing Agreement for Pilot Programme for Preservation and Restoration of Cultural Heritage in Conflict Areas in Western Balkans for 2008, between Bosnia and Herzegovina and the Commission of European Communities.

The proposer, Ministry of Finance and Treasury, will provide the Proposal Basis to the Presidency of B-H, for further procedure, and Minister of Finance and Treasury is proposed for the signatory on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for Conclusion of an Agreement on Cooperation between the Ministry of Finance and Treasury and International Financial Cooperation for Financing Foreign Investment Generation in Bosnia and Herzegovina Project.

The proposer, Ministry of Finance and Treasury, will provide the Proposal Basis to the Presidency of B-H, for further procedure, and Minister of Finance and Treasury is proposed for the signatory on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for negotiations and conclusion of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Kingdom of Thailand on visa lifting for holders of diplomatic and service passports.

The proposer, Ministry of Foreign Affairs, will provide the Proposal Basis to the Presidency of B-H, for further procedure, and Minister of Foreign Affairs, is proposed for the signatory on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for negotiations and conclusion of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Sultanate Oman on mutual visa lifting for holders of diplomatic, special and service passports.

The proposer, Ministry of Foreign Affairs, will provide the Proposal Basis to the Presidency of B-H, for further procedure, and Minister of Foreign Affairs, is proposed for the signatory on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for negotiations and conclusion of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Syrian Arab Republic on mutual visa lifting for holders of diplomatic and service passports.

The proposer, Ministry of Foreign Affairs, will provide the Proposal Basis to the Presidency of B-H, for further procedure, and Minister of Foreign Affairs, is proposed for the signatory on behalf of B-H.

The Council of Ministers of B-H defined individual proposal bases for acceding to international conventions on children’s rights, as follows:

-          Proposal Bases for Acceding of Bosnia and Herzegovina to Council of Europe Convention on Protection of Children from Sexual Exploitation and Abuse;

-          Proposal Bases for Acceding of Bosnia and Herzegovina to Council of Europe Convention on Contact Concerning Children;

-          Proposal Bases for Acceding of Bosnia and Herzegovina to the Hague Convention on the International Recovery of Child Support and Other Forms of Family Maintenance.

The proposer, Ministry for Human Rights and Refugees, will provide individual proposals to the Presidency of B-H for further procedure.

The Council of Ministers of B-H defined individual decisions on ratification of the following international treaties:

-          Proposal Decision on Ratification of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Serbia on Police Cooperation;

-          Proposal Decision on Ratification of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Croatia on Police Cooperation in Combating Cross-Border Crime;

-          Proposal Decision on Ratification of a Financing Agreement between Bosnia and Herzegovina and European Commission on 2009 IPA State Programme (Part II).

The Proposer, Ministry of Foreign Affairs, will provide proposal decisions to the Presidency of B-H for their adoption.

Upon a proposal of the Ministry of Justice, the Council of Ministers of B-H took a Decision on professional exam at B-H level for trainees, candidates with high education, and employees at the level of B-H.

The Council of Ministers of B-H did not come out on a Proposal Decision on Appointment of Work Group for Development of Draft 2011-2015 Coordinated Policy Document for Youth in Bosnia and Herzegovina.

Upon a proposal by the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision on defining annual quota of work permits for foreigner in Bosnia and Herzegovina for 2011.

Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H adopted a Decision on appointment of State Committee for Cooperation of Bosnia and Herzegovina with UNESCO and on the reimbursement level for Committee members.

Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H adopted a Decision on Appointment Committee for Demining in Bosnia and Herzegovina.

Members appointed into the Committee for a two year term are Mustafa Pašalić, Aleksandar Damjanac, and Zlatko Horvat.

Upon a proposal of the Public Procurement Agency, the Council of Ministers of B-H adopted a Decision on implementation of public procurement procedure for Institutions of B-H.

Upon a proposal of the Public Procurement Agency, the Council of Ministers of B-H adopted a Decision on appointment of a Selection Committee for selection of the Public Procurement Agency Board.

The Committee will be comprised of the following members:

-          Sehija Mujkanović, Ministry of Finance and Treasury;

-          Dragan Granzov, Ministry of Justice;

-          Marijan Baotić, Ministry of Security;

-          Milenko Pandurević, Ministry of Foreign Trade and Economic Relations; and

-          Džinita Fočo, Public Procurement Agency.

Upon a proposal of the Agency for Identification Documents, Evidence and Data Exchange of B-H, the Council of Ministers of B-H took a Decision on amendments and supplements to the assessed value of the “SDH network extension Project for data transfer in the Agency for Identification Documents, Evidence and Data Exchange of B-H”, to include the Multi-Year Capital Investment Programme for 201-1014.

Upon a proposal of the Ministry of Finance and Treasury, the Council of Ministers of B-H took a Decision on appointment of a Monitoring Committee for control of use of funds approved for procurement/construction of buildings for Institutions of B-H.

The Monitoring Committee is comprised of the following members, Vlatko Dugandžić, chairman, Ranko Šakota and Sehija Mujkanović.

The Council of Ministers of B-H considered and adopted Information of the Ministry of Defence from SEE Defence Ministers Organisation Summit, held in Tirana on October 11 and 12, 2010.

The Council of Ministers of B-H considered and adopted Information of the Ministry of Defence on Signing a Defence Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of Montenegro, carried out in Podgorica, on Oct. 14, 2010.

The Council of Ministers of B-H considered and adopted Information concerning impossibility to implement a task from the 2010 Council of Ministers Work Programme, namely the Proposal Geodetic Strategy for Bosnia and Herzegovina, prepared by the Ministry of Civil Affairs.

The Council of Ministers considered Information on Implementation of Framework Law on High Education in Bosnia and Herzegovina, and in that regard it concluded the following:

-          The Council of Ministers urges Cantonal Ministries of Education where enactment of the Law on High Education, harmonised with the Framework Law on High Education in B-H is yet to be completed,  to fulfil their commitments as early as possible;

-          The Council of Ministers urges all Cantonal/Entity Ministries of Education, which enacted the Law on High Education, to develop and adopt by-laws regulating the management of high education institutions;

-          The Council of Ministers expects two agencies for high education  (Agency for Development of High Education and Quality Assurance and Centre for Information and Recognition of High Education Documents) to intensify activities within their competence based upon the Framework Law on High Education in Bosnia and Herzegovina.

The Council of Ministers of B-H considered and adopted Information on implementation of Annex “A” of the Agreement on Succession Issues of Former Yugoslavia, and in that regard, it concluded the following:

-          The Ministry of Finance and Treasury is in charge to step-up activities on implementation of the Annex “A” of the Agreement on Succession Issues of Former Yugoslavia;

-          The authorised negotiator for the Annex “A” is in charge to undertake all needed measures to start negotiations within the Joint Work Committee for Implementation of Annex “A” of the Agreement on Succession Issues of Former Yugoslavia;

-          The Ministry of Defence is in charge to deliver all required assistance to the negotiating and expert team for implementation of the Annex “A” of the Agreement, so as to start negotiations on division of military movable and immovable property referred to under Annex “A”, as effective as possible.

The Council of Ministers of B-H considered and adopted Information on operations of the Work Group for Coordination of Activities in Tourism for January-September 2010, and in that regard, it concluded the following:

-          The Work Group for Coordination of Activities in Tourism is in charge to continue its activities on harmonisation of list of international fairs to participate at, in coordination with the Touristic Community of Federation of B-H and Touristic Organisation of RS;

-          The Work Group for Coordination of Activities in Tourism is in charge to continue its participation in the FIRMA Project, implemented by USAID and SIDA, as well as to continue cooperation with other donors in touristic sector (EU, UCODEP, GTZ);

-          The Work Group for Coordination of Activities in Tourism is in charge to continue monitoring of activities on preparation and enactment of Entity and the Brčko District of B-H Tourism Development Strategies, and, following their adoption, initiate their harmonisation and adoption of a state level strategy;

-          Ministry of Foreign Trade and Economic Relations is in charge to deliver these conclusions to the competent Entity Ministries and Brčko District Government, in order to support the Work Group for Coordination of Activities in Tourism to intensify its activities;

-          The Work Group for Coordination of Activities in Tourism is in charge to report on its activities to the Council of Ministers twice a year.

The Council of Ministers of B-H considered and adopted a Report in implementation of the Srebrenica Reconstruction and Development Operative Plan from the reserve funds of the B-H Institutions Budget for the period December 2007 - June 2010, and in that regard, it concluded the following:

-          Within the utility and social infrastructure project, construction of Dubak-Negačevići-Rađenovići (Krst) road subproject, the transfer of KM 270,000.00 to the contracting agency is approved, including payment to the developer for already completed works;

-          The remaining unutilised sum of KM 1,168,944.84 is approved for transfer to the account of the contracting agency to effectuate payment as proscribed under the Srebrenica Reconstruction and Development Operative Plan;

-          The Contracting Agency is in charge to seek consent from the Monitoring Commission for Funds Spending before each payment from the remaining part of unutilised funds;

-          The Contracting Agency is in charge to report on utilisation of the remaining part of finances;

-          The Council of Ministers consents to a special decision on reimbursement to Monitoring Committee members for implementation of the Srebrenica Reconstruction and Development Operative Plan, including to the Committee member in charge for financial monitoring, which all will be paid at the account of the institutions appointing them.

The Council of Ministers of B-H considered the first Report of Bosnia and Herzegovina on implementation of Social Chart (revised), prepared by an intersector work group comprised of representatives from competent institutions, of B-H, and in that regard, it concluded the following:

-          The first B-H Report on Implementation of the European Social Chart (revised) for group IV (children, families and migrants) for Articles 7, 8, 16 and 17 is adopted and will be sent to the Secretary-General of the Council of Europe in Strasbourg so that a fulfilment of B-H obligations following the ratification of the European Social Chart (revised) is possible;

-          The Council of Ministers is obliged - pending the conclusions of the European Committee on Social Rights and Government Committee on European Social Chart of the Council of Europe (both Committees will consider B-H Report), and in case the legislation and practice in B-H are found not aligned with the ratified Articles of the European Social Charter (revised) - to take all required measures to harmonise and fully apply these in view of respect of human, social and economic rights, according to European standards.

-          The Ministry of Human Rights and Refugees is in charge to provide to the first B-H Report on Implementation of the European Social Chart (revised) for group IV (children, families and migrants) for Articles 7, 8, 16 and 17 to the Secretary-General of the Council of Europe in Strasbourg and Associations of Employers and Trade Unions in B-H.

The Council of Ministers of B-H considered and adopted a Report from the Ministry for Human Rights and Refugees on activities of the Council of Ministers Board for Roma Population, for the period June 2009-October 2010.

The Ministry for Human Rights and Refugees is in charge to inform the Board for Roma Population of the issues relevant to the Roma population, to be discussed at the Council of Ministers.

The Ministry for Human Rights and Refugees is in charge to develop a proposal modalities of use of all-level budget funds for the needs of implementation of action plans for employment, housing and health care issues of the Roma population, including the implementation of obligations from the Decade of Social Inclusion of Roma 2005-2010.

The Council of Ministers granted its consent for the following institutions’ individual specifications of work posts for secondary level of education classified by salary levels, with an accompanying obligation that all the specifications should be brought into conformity with the Ministry of Finance and Treasury opinion:

-          Agency for Police Support;

-          Public Procurement Agency; and

-          Ministry of Transport and Communications.

Upon the proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H appointed Damir Đebo from Croat people and Milena Raković from minorities, as members of the Centre for Information and Recognition of High Education Documents (CIP) Managing Board, for a three year term, starting form Oct. 30, 2010.

The Council of Ministers adopted a Decision on allocation of current reserves funds from the 2010 B-H institutions Budget for procurement of facilities to accommodate B-H institutions in Mostar.

The Council of Ministers adopted a Decision approving the construction of the B-H State Prison - the project to be included into the Multiyear Capital Investment programme 2010-2013.

The Council of Ministers of B-H is informed of a request for visa issuance to Council of Europe experts from Kosovo to attend the Round Table on Human Rights Protection in SEE, to be held in Sarajevo, on December 1 and 2, 2010.

In that regard and in line with the Conclusion from the 86th session of the Council of Ministers, held on may 7, 2009, taken in relation to the position of the Presidency of B-H on legality of documents owned by Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visas on a separate sheet for two persons from the list accompanying the relevant request, to take part at the Round Table on Human Rights Protection in SEE, to be held in Sarajevo, on December 1 and 2, 2010, for the period of the Conference.

The Secretariat General of the Council of Ministers is in charge to provide the above conclusion to the Ministry of Foreign Affairs of B-H for further procedure.

The Council of Ministers of B-H defined a Proposal Basis for Conclusion of Supplement No.3 to the Financing Agreement between Bosnia and Herzegovina and Commission of European Communities in respect to the National Cooperation Programme within the IPA Component for Assistance in Transition and Institution Building.

The Ministry of Finance and Treasury is in charge to provide Proposal Basis to the Presidency of B-H, with a proposal of Head of the Directorate for European Integrations Nevenka Savić for the B-H signatory.

The Council of Ministers of B-H is informed of a Report on the procedure implemented for a job competition for selection and appointment of manager of Agency for Labour and Employment of Bosnia and Herzegovina.

In that regard, the Council of Ministers of B-H appointed Sanja Jokić for Deputy Manager of the Agency for Labour and Employment of B-H.

The Legislative Office of B-H is in charge to prepare Decision on Appointment, which will take effect on the day of its publication in the “Official Gazette of B-H”.

The Council of Ministers of B-H took a Decision on allocation of current reserves funds from the 2010 B-H Institutions Budget for covering transportation and fuel costs in favour of the Ministry of Security.

The Council of Ministers of B-H supported a proposal to organise a promotion trip to the Seat of European Union and three EU member countries for a group of 66 representatives of NGOs and universities, journalists and officials of B-H institutions on a day the non-visa regime takes effect.

The Ministry of Security is in charge to organise the promotion trip, secure transport, accommodation and other necessary requirements for trip. The funds for all the participants will be secured from the Ministry of Security Budget.

The Council of Ministers of B-H supported a proposal to organise a public promotion event in Sarajevo on the eve of non-visa regime taking effect.

The Ministry of Security is in charge to organise the public promotion event.

Funds for the organisation of a public promotion event will be secured from the Ministry of Security Budget for 2010.

The Council of Ministers of B-H took a Decision to set-up a committee for purchase of buildings for accommodation of embassies of Bosnia and Herzegovina in Belgrade, Zagreb and Berlin.

The Council of Ministers took a Decision on funds allocation from 2010 B-H Institutions Budget reserves in amount of KM 350,000.00 for purchase of a building for accommodation of the B-H Railways Regulatory Board.

The Council of Ministers of B-H took a Decision on allocation of KM 10,000 from the Co-Financing Sports Events Grant current account for the selection of B-H Athlete, organised by “Nezavisne Novine“ daily.

The Council of Ministers of B-H took a Decision on allocation of KM 50,000 from 2010 B-H Institutions Budget reserves for aid to earthquake affected town of Kraljevo.

Working conclusion:

The Council of Ministers sought an explanation from the Agency for Civil Service of B-H on reasons for impermissibly lengthy competition procedures for selection of managing civil servants.
